    I remember a case where a boy, 13, had sexual relations with about 6 different boys, one of them was 9 years old, and even though none of the boys pressed charges, the 13 year old was charged with rape and classified as a sex offender. I can't recall his name, but the case was very telling on how inadequately we handle minors and sex.

    I think alot of people are missing the point, the reason it's ruled as rape isn't because one party is being "forced". It's rape because one party holds power over the other, often times it's the teacher/student case but age alone adds a situation in which one party has more authority and is abusing their power, whether it be obvious or hidden. You might think both parties are consensual but the authority one holds over the other is definitely a factor which is being used to some extent in a majority of these cases.

    However, the 9 year old consented, with what you're saying, we'd need to have a classification for minor-minors to be able to have a justification for that.

    I'm also not sure if in that case there was any anal penetration.

    even if the 9 year old said yes then there is an underlining issue like maybe a history of sexual abuse. Still doesn't make it right

    I've heard of children engaging in sexual activity as early as age 8, for whatever reason they do it, we tend to oppose it, if not for moral reasons, because we don't want them to be abused by someone who simply has more power. It becomes an issue however, when you label a 13 year old a sex offender for engaging in consensual sexual activity with another minor.

    Now, what you have to ask yourself is, would you arrest two 8 year olds for having "sex", of any sex, because you find it morally repulsive even if they're both minors, or do you find it less morally repulsive because they're both the same age?

    It's better to be consistent.

    Well what are you considering Sexual activity? because while children of that age are naturally curious I.E sneaking a peak at a sister/mother/brother/father that is generally were the curiosity ends. Anything further is generally a result of something else for example being exposed to explicit material at an early age or being abused by someone repeatedly. This is why Children that are abused sometimes become abusive themselves which is probably the case for the 13 year old.

    There is a government report titled "The Needs and Effective Treatment of Young People who Sexually Abuse: Current Evidence" that classify children abusers into three groups which are:

    Group one – Developmentally impaired – more of the sex offenders and some sexual assaulters. Higher levels of enuresis, encopresis, speech and language delay, learning difficulties, lower IQ, higher levels of victimisation through sexual abuse (intra and extra-familial), emotional abuse, bullying, high levels of sexually inappropriate behaviour at school and in the community, especially in children’s homes, higher level of social isolation and withdrawn behaviour.

    Group two – Violent, physically abused group – no child molesters found in this group.

    Some of the young people in this group had committed offences against peers and women, higher levels of violent non-sexual offending, higher levels of childhood physical abuse, higher levels of violence at school, failure to attend school and subsequent expulsion, no social isolation and no withdrawn behaviour at school, more foster care and residential care moves, more offending and convictions of any type, more likely to blame criminal behaviour on mental and emotional instability, more likely to have relationship problems with father or father figure, more evidence of hypermasculinity.

    Group three – Socialised delinquent group – most well adjusted, higher number of sexual assaults on female peers and women, some child sex offenders, fewer with histories of emotional and behavioural problems, neglect and sexual abuse, physical abuse, SEN and peer relationships problems, lower number of foster placements and fewer placement moves, higher IQ, higher reading age, higher age at first recorded offence, less delinquency, fewer family problems and educational problems, lower self-reported psychological problems.

    Hendriks and Bijleveld (2004), found that adolescents who abuse children showed higher levels of neuroticism and psychopathology, were more likely to have been bullied, have low self-esteem and have less contact with their peers. Significantly, more had abused boys and were more likely to be related. Peer abusers were more likely to have assaulted a stranger than a true peer.


    Getting back on point there is actual proof that children that are abused at an early age often "act out" sexually.

    Children who were sexually abused may become involved in sexual acting-out behaviors, particularly when they reach adolescence, a time of increasing biological urges and exposure to sexual education. Under normal conditions, sexual behavior develops gradually over time, with youth showing curiosity and then experimenting with themselves and others. When children are sexually abused, however, they are prematurely exposed to material they do not understand and cannot make sense of.

    Moreover, children become conditioned to respond to certain things. In many instances, adults who interact sexually with children may reward them before or after the event. The children are conditioned to believe that if they engage in certain behaviors they will be rewarded. This is pure learning theory: children repeat acts for which they receive positive reinforcement.

    A judge who was doubting the sexual abuse of a 3-year-old child called everyone into his chambers and hoisted the young girl on his lap so that he could interview her. The moment he placed her on his lap, she reached under his robe and began fondling his genitals. She clearly had been conditioned to believe that when a man sits her on his lap, he expects this type of behavior. The judge quickly reversed his opinion and went forward with the case of sexual abuse.

    Some children who were sexually abused also may become sexually provocative, dressing and talking in a manner that puts them at risk of further sexual exploitation.

    So you see I take issue when you say that an 8 or 9 year old has the cognitive ability to give consent for sexual acts.

    You misunderstand. I did not say that 8 year olds or 9 year olds are capable of consent in sexual relationships; i am no child psychologist. I don't know whether some kids mature sexually earlier than others, and whether all young kids lack the cognitive ability to consent or whether there might be exceptions. Neither did i say that the kid's actions should not be punished in some light way. What i was saying was that you can't just label a 12 year old (he was 12 not 13) a child molester when he engages in sex with other kids his age or even slightly younger, when said kids were willing participants. It makes no sense, because he is a minor, and the kids were willing participants.

    She's not bad >_> I don't personally see anything ethically wrong with what she did. If that happened to me when I was 13-16 I wouldn't have been traumatized, I'd have probably been bragging about it etc >_>

    Pohibaba said it right however. These cases need to be evaluated on a case-by-case basis, but as that's not really practical it is better to just enforce a blanket law preventing sex with minors.

    Teacher was stupid for letting it go on for so long / leaving written evidence.

    Obsessed teacher "raped" student 300 times.

    ROCKLAND, Mass., Jan. 9 (UPI) -- A married Massachusetts teacher accused of statutory rape allegedly had sex with a minor 300 times, police said.

    Police said Christine A. McCallum, 29, had sex with the student on the boy's kitchen floor, in the shower and in the living room -- all beginning when he was 13-years old, the Boston Herald reported.

    The alleged victim is now 16. He said he and the teacher had sex "possibly every other day," a police report said.

    McCallum faces three charges of statutory rape. She was being held on $10,000 bond.

    "The defendant is obsessed with this young child," Assistant District Attorney Michael Scott was quoted by the newspaper as saying.

    McCallum has been placed on administrative leave from her job as a fifth-grade teacher in Abington, Mass.
