The problem with the prosecution rate in sexual assault cases that are reported is that the majority of victims tend to report it after all evidence is destroyed with no witnesses to corroborate their story. Very rarely does the victim go immediately to a hospital to have a SAFE kit performed. The army has excellent programs in place like SHARP or Victim Advocates who are there specifically for the victim to guide and support them through the process on how to handle being sexually assaulted. Unfortunately soldiers don't use these programs or won't report a sexual assault because the stigma of rape is a black man jumping out from the bushes, not your buddy taking advantage of you when you're both trashed or your superior who's trying to be "helpful." So you'll have victims come forth with the allegation two~three weeks after the incident after they learn what's available to them. The longer it goes unreported the more difficult it becomes to investigate.

The next problem is that any subject with half a brain will claim consensual sex. Usually the only way to prove these cases is either through a confession during a subject interview, a pretext phone call with the victim wherein the subject runs his mouth and inadvertently confesses, or a witness who literally saw them fucking either consensually or not. The investigator/agent can scream at the DA/SJA til they're blue in the face that they're convinced a sexual assault occurred, but without any credible evidence or testimony the subject is walking.

I also highlighted the important part for you since you sound like you've seen one too many cop shows. This is the most commonly reported form of rape in the military which tends to ultimately boil down to he said/she said. Sexual assault investigations are the most difficult to prove or disprove for this very reason.

I can count on one hand the amount of cases we've had in the past year where the subject from the onset had a clear intent to violently rape an individual, with or without an impaired victim.

I thought a lot of people were well aware that the guys that get away with it tend to keep doing it, too. Less are aware that those who are victimized have a high tendency to be repeatedly victimized, especially when no justice is served, but that's a huge issue as well.

That you're blatantly being misleading tossing the word rape around with the military having done absolutely nothing about it. Sexual assault investigations are already scrutinized with the utmost integrity every step of the way by a disinterested party. There's no secret squirrel agenda to get soldiers off the hook.

The proper policies and procedures are already in place, the problem is the military culture of everyone having to get absolutely shit-faced every single weekend with individuals they've met maybe a few weeks~months ago.

Go on deployment, and let the locals buy you drinks. You think you're good, then you wake up in your rack on the ship, wondering where the night went. There are exceptions to nearly every rule. While I agree that one's conduct while drinking is still their responsibility, you can't quite make a blanket statement like that without at least attempting to realize that there are times when that shit simply isn't possible.
