Time Warner doesn't seem to give a shit - I download 15-20 anime shows a week and probably do around 100gb down/50gb up a month. Never gotten a C&D either but I don't use torrent sites like piratebay, megatorrents, etc.

Licensed anime is illegal but hell, everyone downloads it anyway. It's ass to pay to watch a show you may never want to see again (as is the case with most of the trash now) when Japan gets it for basically free on TV. Sure buy the DVD if you like the show, but otherwise fuck it.

As for your second statement, that's not completely true. Many animes are illegal to distribute online fansubbed regardless of whether they are licensed in the US or not. Some companies take it as promotion and don't care, other companies have sent C&D orders to torrent and direct dl sites. It really depends on the company and how much attention they pay to the internet. The anime industry worldwide is losing a ton of money due to people who just download and don't buy any, so for some companies I'm sure they feel it's beneficial to stop distribution wherever they can - not that that's going to really stop anyone, but they do try.

Meh, I got 3-4 forwarded DMCA notices from Charter back in February/March courtesy of HBO and NBC lawyers. As I recall, the onus is on the service provider to act, and not the individual; naturally, your provider is going to shift that burden onto the user, but in most cases, by the time you've received the notice you probably stopped seeding long ago and so there's nothing left for you to do. This probably varies by provider, all of my notices came via snail mail several weeks after the alleged infringements occurred.

If you're getting notices from your ISP, just exercise a bit of control and care about where/how you download. They're (they being the copyright holders or their legal representatives) obviously not actually dragging you into court, just trying to instill the idea that they could do that if it were potentially profitable for their client if there were sufficient evidence to do so.

Bear in mind, however, legislation such as ACTA and PRO-IP may be game-changers which shift things against the favor of your garden variety internet copyright infringement (possible shifting of offenses which were previously civil into the criminal domain, bit drunk atm and definitely not a lawyer so i can't really comment on the specifics). For your own sake, you might do well to go to official sources like hulu whenever possible.
