Why do you think he had two choices and chose jail over community service? He had a choice of community service or going to trial and trying to get off. He took a gamble and lost, he didn't choose 5-10 years in jail.

Important to note that the community service was contingent on admitting guilt.

Wow. Very sad story. I noticed since moving to NYC that jumping tends to be a pretty common suicide method. Some article I read recently said it's more common for men to jump than women.

Bullying in the 21st century, huh? Some fucking awful people who did that shit to him. They should get sentenced with more than what they have been, IMO.

edit: Everything I'm reading that's current about this case states that he still doesn't think he caused the suicide. Doubt the counseling part will matter. also said charged when I meant sentenced. I've corrected that.

Sorry I said charges and intended to say sentence. My bad. I don't really see how you don't feel filming and streaming a homosexual encounter for others to view when the subjects didn't agree to it, & tweeting about it etc, is not "outing" someone. I don't see it that way.

Because he had already told his parents and other friends he was gay? Because he was openly bringing men back to his dorm room? The problem wasn't that the kid was hiding that he was gay, the problem is that his privacy was invaded with the intent to humiliate him.

I suppose my point is that it is his right to tell who he wants and decide who knows he's gay. He clearly wasn't THAT open. I know several people who are gay and haven't told EVERYONE -- just close friends and parents. That doesn't mean they want their homosexuality broadcasted to anyone and everyone. I don't judge them either, people have their reasons for their secrecy. He was bringing people back to his dorm room, but what, a guy can't have a friend visit his dorm room? Nothing implies that every guy who entered his dorm room engaged in sexual activity with him. They could've been playing Halo or some equally awful game that men inexplicably love to play together. I don't think bringing a friend to your dorm room qualifies as "OPENLY" unless they were having sex with the door wide open to the hallway or inviting strangers to watch them do it.

I agree, and I think Clementi had suffered way more than just what the charges dictate. From the article I linked:

IMO he got less than what he deserved, based on what you just said. Destroying someone's entire life? Pushing them to suicide via extreme humiliation? That's a big deal.
