Well, yes, but that's not really what I meant.
If BG has media from a game that the developer doesn't want shown, they can potentially receive DMCA takedown requests and whatnot from SE (e.g.
Capcom getting YouTube to takedown videos of hidden SSF4:AE characters before they were officially released). But DMCA takedowns don't extend to descriptions or reviews of a product.
It's the difference between complying-with-an-NDA (which BG is not subject to, as they didn't agree to it) and complying-with-the-DMCA (which BG potentially is subject to).
