    Canadian illegal downloading law.

    Canadians accustomed to illegally downloading copyrighted material without facing consequences could be in for a shock this year.

    The final piece of the federal Copyright Modernization Act took effect on Jan. 1, requiring Internet service providers (ISPs) and website hosts to relay letters from copyright holders to customers associated with the unique Internet Protocol (IP) address where the illegal downloading is alleged to have occurred.

    While such notices do not carry any immediate legal ramifications, Internet lawyer Allen Mendelsohn told CTV’s Canada AM that they do serve as “a warning” that a copyright holder has noticed illegal downloading activity at your IP address, and could decide to sue.

    The law does not include a stipulation that the customer must stop downloading the material or remove it from any websites to which they may have posted, but it does allow a copyright holder to sue individuals. Lawsuits could seek up to $5,000 for downloading copyrighted material for personal use, and up to $20,000 for a download that led to commercial gain.

    While the cost of litigation, and the relatively small return, could discourage copyright holders from suing, Mendelsohn notes it could be more worthwhile to sue a large number of people at once.

    The ISP or website host must also keep the notification letters for six months, should the copyright holder decide to sue. However, the ISP or website host cannot hand over your personal information unless a lawsuit is launched.
    In the meantime, receiving such a letter may be enough to compel the customer to stop downloading copyrighted material, he said.

    Customers should expect to receive a notice via email, Mendelsohn said.

    Netflick starting to crack down on canadians accessing netflick USA. Can I still stream from sites? What will trigger an email? This seems to heave already happened in the US, what can Canadians look forward to?

    I mainly DL music and watch tv shows. Movies as well, but will stop if need be. Figures with PB down, pirating would go back underground. But this new law seems to be a bigger issue.

    They always seem to ignore porn producers rights so probably free to continue with that. In USA the primary focus is mainstream music artists and movies

    Very likely, but I suspect Netflix is not the only to blame here.

    I wanted to ask this as well. Tried making a post in Tech the other day but the forum kept preventing me but now this is here.




    That is a breakdown of what I got in email from my provider. Should i be ultra careful from here on out? Member of that sharing website that has its own thread in the tech section (forum automatically not letting me mention it ) so not sure if that even covers me? Is that considered a Private Tracker? How about streaming sites etc? Used them regularly so bit concerned there.

    As someone who's not in some super anal cool kids share club that's all nazi with sharing, my general advice would be to maybe 1:1 at most, not let things run 24/7, and avoid day 1 downloads... maybe giving it a few weeks or so, really, if you must absolutely watch and can't wait for Redbox/Netflix/etc..

    Basically, this tends to scream more of scare tactic than targeting every little fish. It's the big ones hoovering up data 24/7 that'll probably be the first targets of any action.

    I'm not sure how this is different than what I've heard happening already. I've had friends and family members who have gotten these notifications in the past, how is this any different from that?

    Would say it depends on the ISP. Some throttle you. Others may cancel service entirely. Things like the mom getting fined a stupid amount for downloading one song generally don't seem all that common, which is why I'm more the mind of just not making yourself stick out as a user of the net.

    Before the ISPs could choose to send you the letter. Now they legally have to.
