If there is probable cause that a person is conspiring with a foreign entity (nation, terrorist group, etc) the secret FISA court is where the FBI would present evidence to get such a wiretap approved.
The subject of a FISA warrant isn't privy to this information.
Sorry, let me be more clear. Obviously making the subject of a FISA warrant aware of the warrant would defeat the purpose, but if that subject were later to become aware he was being monitored independently, could he not take the matter to court and demand proof that the warrant exists and that he was not being monitored illegally?
Well, while that's terrifying, I find it totally believable for our country.
It's not the fact of the wiretapping, it's the fact that the government has no responsibility to prove that a court found sufficient evidence to justify the wiretapping.
