If Collins and Murkowski vote present, would that mean Pence would be the tiebreaker at 49+1 yes votes?
Pence can break a tie, yes. I cant see Collins or Murkowski voting no, and Romney voting yes tho, and if he does then its dead in the water.

But the two ladies voting "present" means the sitting Senate is effectively at 98 instead of 100, correct? That would mean up to 2 more Republicans can vote "no" and Pence would still break a 49 tie.
Well honestly the larger play here is keeping Roe v. Wade intact, which is the top Republican legal priority. If it ever gets overturned they lose the biggest driver of single-issue voters to the polls, the ongoing invisible existential threat of women controlling their own bodies.

Everyone that is using their... convictions... right now is not really using it. They know that if they push this through, and Dems sweep this election, they will make this all pointless. If they wait, and the dems win, nothing changes, and the courts till stay right-leaning. If they push this through and the dems grow some balls, they pack the court and it goes liberal.
Edit: That said, if they wait and the dems don't take the senate.... expect them to push through the lame duck.
