Quick research shows they are screwed when it comes to any guaranteed money and cap related to it. But they had an insurance option, they could have bought to protect against injury and non-guaranteed money related to the cap. I guess it depends if they paid or not.
Another option: Smith could retire and take only his guaranteed money, but Washington would have the option to sue for 80% of it. Highly unlikely this happens.
Edit: Additional note - The cost of the insurance premium would still go against the cap, and would have been around $10m for his contract total.
