Lawyers for the American Civil Liberties Union told a federal judge Tuesday that the Trump administration has taken nearly 1,000 migrant children from their parents at the U.S.-Mexico border since the judge ordered the United States government to curtail the practice more than a year ago.

In a lengthy court filing in U.S. District Court in San Diego, lawyers wrote that one migrant lost his daughter because a U.S. Border Patrol agent claimed that he had failed to change the girl’s diaper. Another migrant lost his child because of a conviction on a charge of malicious destruction of property with alleged damage of $5. One father, who lawyers say has a speech impediment, was separated from his 4-year-old son because he could not clearly answer Customs and Border Protection agents’ questions.

Acting Homeland Security secretary Kevin McAleenan has said that family separations remain “extraordinarily rare” and happen only when the adults pose a risk to the child because of their criminal record, a communicable disease, abuse or neglect. Of tens of thousands of children taken into custody at the border, 911 children were separated since the June 26, 2018, court order according to the ACLU, which cited statistics as of June 29 that the organization received from the government as part of ongoing legal proceedings.

Catch & Release policy to end next week.

"With some humanitarian and medical exceptions, DHS will no longer be releasing family units from Border Patrol Stations into the interior," McAleenan said in his prepared remarks. "This means that for family units, the largest demographic by volume arriving at the border this year, the court-mandated practice of catch and release due to the inability of DHS to complete immigration proceedings with families detained together in custody — will have been mitigated."

In a statement issued by DHS, the agency outlined how it intends to carry out its new policy starting next week.

"If migrant family units do not claim fear of return, they will be quickly returned to their country of origin, in close collaboration with Central American countries," the statement read. "If they do claim fear, they will generally be returned to Mexico under the Migrant Protection Protocols (MPP)."

The Trump administration announced an accord Friday that will allow the United States to divert asylum seekers from the U.S. border to El Salvador, pushing migrants into one of the most dangerous countries in the world. The deal between the two governments is the latest measure aimed at creating new layers of deterrents to the influx of migrants applying for protection on U.S. soil.

Kevin McAleenan, the acting homeland security secretary, signed a “memorandum of understanding” with Salvadoran Foreign Minister Alexandra Hill in front of television cameras in Washington, but the two officials gave few details and no indication when their accord would take effect

    .
McAleenan, who traveled to El Salvador for talks last month with President Nayib Bukele, praised a “shared responsibility” on migration that was part of a broader deal to accelerate economic development in Central America with the goal of keeping migrants in their home countries.

Listen, Mexico is a glowing, 1st world country and not at all a crime infested shithole people will literally risk death to flee from by the thousands. Having them take a safe, friendly trip in El Savador while their petition is being considered is very humanitarian all things considered. Especially compared to America which as I understand it, is a fascist, racist, patriarchal distopia where our God Emperor HITrumpLER kills minorities by the millions. Frankly IDK why anyone wants to come here.

Anyway, my real response... Yah, legit pretty fucked up to pick El Salvador what with, aside from its rampant problems with gang violence and more, it being a FUCKTILLION MILES from the actual border. It was picked with intent.

A federal judge in Los Angeles has blocked the Trump administration from activating new regulations that would have dramatically expanded its ability to detain migrant children with their parents for indefinite periods of time, dealing a blow to the president’s efforts to tamp down unauthorized border crossings.

U.S. District Judge Dolly M. Gee issued the permanent injunction Friday, hours after hearing arguments from the Justice Department and advocates for immigrants in a long-running federal case in the Central District of California.

Lawyers for the Justice Department had urged Gee to allow the Trump administration to withdraw from the Flores Settlement Agreement, a 1997 federal consent decree that sets basic standards for detaining migrant children. The decree led to a 20-day limit for holding children in detention facilities that have not been licensed by the states for the purpose of caring for minors.

President Trump has called Flores a “loophole” that has enabled hundreds of thousands of families, many from impoverished Central American countries, to cross the southern boundary and claim asylum. Those migrants generally are quickly released into the United States because of the 20-day limit on detaining children.

The number of migrants taken into custody along the southern U.S. border soared to nearly 1 million during the government’s fiscal year that ended Sept. 30, according to U.S. Customs and Border Protection data released Tuesday.

The number of unauthorized crossings from Mexico into the United States marked the highest volume in 12 years, amid a record influx of Central American families that peaked during the spring, overwhelming U.S. agents, border stations and immigration courtrooms.

Mark Morgan, the acting CBP commissioner, told reporters at a White House briefing that more than 52,000 migrants were taken into custody in September at U.S. ports of entry and between them, a decline of 18 percent from August.

    It's official!

Attorney General William Barr issued the rule, which is set to be published in the Federal Register on Tuesday, with the expectation that federal authorities will gather DNA information on about 748,000 immigrants annually, including asylum-seekers presenting themselves at legal ports of entries.

In the proposed regulation, Barr describes the DNA sample as a "genetic fingerprint" that can uniquely identify a person, "but they do not disclose the individual's traits, disorders, or dispositions."

Justice Department officials hope to send the DNA information from migrants to an FBI database known as the Combined DNA Index System, which already contains nearly 14 million people who have been convicted of a crime and an additional 3.7 million people who have been arrested.

Thousands of migrant children were sexually abused in U.S. custody, HHS docs say

    https://www.cbsnews.com/news/thousan...rzu2-yx8BB8BQ8

Washington — Thousands of migrant children allegedly suffered sexual abuse while in U.S. government custody over the past four years, according to Department of Health and Human Services (HHS) documents released Tuesday.
In total, between October 2014 and July 2018, 4,556 sexual abuse complaints were reported to the Office of Refugee Resettlement (ORR) — an agency within HHS in charge of caring for unaccompanied migrant minors.

Leaked footage from a privately owned ICE detention center in 2017 shows how guards used force to end a hunger strike.

In the early morning of June 12, 2017, a group of eight Central American migrants decided to go on a hunger strike to protest conditions at the immigration detention center where they were being held in California.

The guards were discriminating against them, they lacked access to clean water, the bonds for their immigration cases were too expensive and they were receiving information only in English.

When detention officers ordered them to return to their beds for a routine population "count," the eight men refused to move from tables in the facility's day room until they could speak to a supervisor or an official with U.S. Immigration and Customs Enforcement (ICE).

Detention officers spent several minutes speaking to the detainees, telling them to return to their bunks. They waived a canister of pepper spray in front of them, then attempted to physically move the detainees.

The video shows the detainees trying to remain seated with their arms linked. But detention officers would later claim they were inciting a "rebellion" and "assaulting" staff.

Detention officers then sprayed pepper spray at the men at least three times and forcibly removed them from the tables.

As they visibly recoiled from the spray, some of the detainees were pushed into walls, pulled to the ground or dragged on the floor by guards.

Afterward, though not seen on camera, five of the detainees were placed in hot showers. Hot water, however, can worsen the painful burning effect from pepper spray, something an internal oversight office at the Department of Homeland Security noted in a review of the incident.

All eight detainees were then sent to "segregation" — ICE's term for solitary confinement — for 10 days for "engaging in or inciting a group demonstration."
