Iirc they have to be or the statute of limitations would have expired on them. NY extends the statute of limitations on this crime if it was done in the service of another crime. So, they are going to have to claim that the falsification was in the service of committing a federal crime for which he was never charged.
Hence bank shot. It isn't going to be crazy if he walks from this and claims he is the most innocent person since the virgin mary
I read that the statue of limitations clock only ticks for days you are in the state, so it wouldn't have necessarily expired for Trump but I'm not sure if that is correct.

Dersh (a very Trump-friendly lawyer) argues that Trump wasn't "continuously" out of NY state because he made multiple visits there over the years and therefore the clock on any misdemeanors and any felonies pre-2018 would be expired.

Any period of time during which the potential defendant is hiding or is otherwise unavailable, doesn’t generally count in calculating the limitations. Accordingly, the New York State statute expressly exempts “any period [when] the defendant was continuously outside the state” or when “the whereabouts of the defendant were continuously unknown and continuously unascertainable in the exercise of reasonable diligence.”
Obviously President Trump’s whereabouts were always known. After all, he was in the White House for most of the time. Moreover he was never continuously out of New York, having repeatedly returned to the state where he maintained a residence until after he left the presidency.
