Dude, just stop paying your mom rent and have her evict you two. Yeah it'll take about 40 days but i don't think you have any more options.

We have no divorce lawyer. She agreed just to default on the divorce and we agreed on everything. She's just pulling the whole, "I can do anything I want because I don't have any ties with you and fuck you," so I'm just really agitated like 70% of my day.

Well first, it's obvious you didn't agree on everything or you wouldn't be in this situation. ^_~ Secondly, because of the second statement, you better make sure the court gives a clear cut rules on child support and child custody orders; otherwise, you're going to find yourself spending a heap of time fighting for custody and/or visitation when you piss her off. I would strongly recommend DO NOT kick her out until you get child custody arrangements settled IN COURT, or you will end up not seeing your son until you get one, no matter what "assurances" she has given you. (If you've already gotten this part settled in court, you can obviously ignore this.)

Third, if you can't afford a lawyer you can try sites like these:

I would recommend finding a few different ones and asking the same question to see if their answers are similar.

The evicting part does sound legit, but I dunno if she could file for a false eviction and sue your mom if your mom just lets you move back in.

She has already defaulted on the court trial. I requested joint legal custody and full physical custody. Basically, we agreed what we both wanted and she didn't show up to the court date on purpose. Now we're just waiting for the divorce to be final.

Even if she does "evict" us, she'll be allowed to move back in because of the whole "marital home" thing going on. As in, since we are legally both married, I can't not let her live with me. The only loophole I found so far is to prove that she's a threat to either my son or myself. Other than that, she can setup a 40-man bukkake orgy in my home and I would just have to deal with that. California divorce laws suck ass.

Can you not just move out yourself and leave her there until the divorce is finalized? Surely there's some sort of legal separation law in CA? Hell, in NC I'm pretty sure you have to be legally separated for a year before you can file for divorce.
