Hey there BG. I need your legal advice yet again. I'm writing this at 3:00AM and have been up for awhile and working all night so sorry if this rambles a bit. As I've mentioned in other post here I was home schooled through my high school years; however, I was unable to finish my program. I was 3 credits away from my senior year but some very serious family problems came up which ended up with me not having access to materials and my contract expired - or so I thought. When you sign up with the program you're given 3 years to complete the program or your contract becomes null. I never gave it a second thought, I just assumed my contract was over and I was done with it.
The current school I go too didn't request my high school transcripts because I had GED transcripts and 15 credits at a local community college. However, the school I'm applying too now requires highschool transcripts. That being said I contacted my high school about 3 weeks ago and requested my transcript. They then told me that I had not canceled my account and I would have to do so now and they would tell me how much money I owed them. "Oh boy.." I thought. Well, I went digging and found the original contract I had signed when I enrolled in the program and it says that if I completed more than 50% of the program I would have a cancellation fee of 100% the tuition which is around 2.2k. Clearly I'm not paying that for them to release my transcripts. However, it says that is only if I cancel my account 5 weeks after the start of the program and I've completed 50% of the program or more. What has me confused is my contract expired well over two years ago. Can they ask me to pay a cancellation fee even though I never actually canceled my account while my contract was still valid and waited til several years AFTER the fact to cancel? This is what the contract says:
Then down a bit farther it says this:(4) If the school is notified of cancellation after completetion of more than 50% of the program, the student will be obligation to [school name here.] for the full tuition cost (100%) of the program.
If they tell me I owe them money when I call them tomorrow, am I justified in telling them to fuck themselves and release my transcripts to me before I take them to court or am I fucked and have to pay this fucking retarded amount of money? Thanks BG.A student enrolled in the high school diploma program has 3 years from the original date of acceptance to complete his or her program. This contract will cease to be in effect after three years from the original date of acceptance. No request for refunds will be considered thereafter.
Note: Somewhat urgent on the replies, I gotta have these sent by tomorrow or I won't make my application deadline for my school.
