Former child molestor sentenced to five years in jail for posting videos on Youtube

    http://www.wftv.com/news/22163478/detail.html

    URL contains video and article.
Best site I could find, even though the writer seems to be a self-righteous little prick.

I'm seriously shaking my head in disbelief, how is this even remotely close to justice?
I never watched his videos, but as far as I know they are immensely popular, popular as in the man made a lot of people laugh.

I only see people complaining about sex-offenders falling back into their old behaviours, now I see someone who's actually trying to resocialize and he's sent to jail because of a ridiculous probation?

I cannot help but think that the judge in question was not quite content with the fact that the man spent the time in jail he was sentenced to.
I understand that people are quite concerned as far as child molestation is concerned, but what's the point of releasing them if you're going to send them back to jail the instant they fuck up, no matter how minor the case is, or in this case, if it even contributes to resocialization?

Resocialization is supposed to be part of justice, he spent his time in jail, atoned for what he did, then he attempts to resocialize and is sentenced to five years for owning a computer because it can be used to hook up with kids, even though nothing was found during an investigation (as far as I know at least)?

I agree that he should have notified authorities of his change of address, but everything else is complete and utter bullshit.

Apparently this is causing quite an outrage, wonder if anything's going to happen.

He broke the law, went to jail. What's the problem here? People who don't want to go back don't violate their probation.

How is this an outrage? He was told part of his probation was to not own a computer yet he did and he posted videos to youtube with it.

He violated his probation. He goes to jail. End of story.

That's exactly the problem, the inability of the relevant authorities to see what's beyond the law.

Now, just in advance, I agree that law must be maintained, no question there.

Sometimes, however, things start to get kind of ridiculous, take this case for instance.

He received the probation due to the fact that he moved without informing the local authorities, molestation-related probation basically.

Then he's sentenced to five years for violating his molestation-related probation even though there was no immediate danger of him molesting anyone.

Sounds kind of weird, but what really gives me a headache is the fact that he violated his probation because he used a means of communication that was essential to his resocialization and even contributed to society.

That's where "thinking beyond the law" becomes important, in my opinion at least, mainly because, as I stressed before, resocialization is just as important an aspect of justice as anything else, so why sentence him for violating molestation-related probations if checking his computer proved that there was no immediate danger?

What's more, aren't the prisons supposed to be rather full right now? Then why put people into jail who aren't even a danger?

That's my take on the matter at least.

Especially with sex offenders, and child molesters to a higher degree, they don't fuck around with parole violations in the least. Could be squeeky fucking clean for 20 years, don't register, back to sing sing you go. It sucks, but what can you do. He shouldn't have had a computer and he should have followed through with his registration compliance.

This is probably the part where we won't come to an understanding regardless of what we say.
I understand that stance, but, not being a parent yet, I probably have no right to say what is wrong or right here anyway.

Regardless of that, right now I think that, no matter how badly someone fucks up, he deserves a second chance. And locking someone up who wants to make use of that is just cruel.

How is YouTube/a computer essential for his resocialisation? Last I checked, Internet doesn't help a person reenter society. Maybe he should have done something like joining a church group or a book club to help himself reenter society, not post videos of himself on a website when it's illegal for him to own a computer.

And as for the reason of his probation in the first place, a registered child molester who just moves without informing local authorties is LUCKY to just get probation. In most cases that can get a person sent right back to jail.

I like teh lolis and everything but I still agree that this guy fucked up and is paying for it. I see no injustice.

Also Darakor you're from Germany which during the 1970s was the second largest producer of child pornography in the world. It's not surprising that your view of the situation is skewed.

Haha, alright, made me chuckle, thanks for livening up the situation. Well played, didn't even know that!

Regarding the probation, I wasn't aware of the fact that he was lucky to have received only a probation, I'm not exactly well-versed when it comes to law, thank you for that.

It's annoying that there's not an awful lot of information regarding this, though, mainly because the exact circumstances that have lead to the probation would be important to accurately judge how great a mistake he made.
Probably not important to most people anyway, but I still think that five years in jail are far too harsh considering he wasn't even an actual threat based on what we know right now.
