    Speaking of the 14th amendment, denying workers the right to bargain collectively may be unconstitutional. I know in Canada it's been partially recognized as a right by the Supreme Court.

    Guartz, the problem is that they never hinted they'd do this while campaigning, and now as soon as they got into power (on a different agenda) this is the first thing they're doing for purely political reasons - and they aren't even following their own rules and laws in terms of chamber proceedings and proper democracy.

    You can think that public sector unions are worthless or redundant or whatever - that's pretty irrelevant when it comes to these lies and abuses of power. They have the votes, they don't have to shit on democracy to do what they want.

    Nah. It would've been challenged long ago, states and the federal government have been stripping collective bargaining rights for years.

    The only way this may be unconstitutional is if (ironically under Citizen's United) it's deemed that the purpose of union busting is to silence their freedom of speech (via campaign money) which is clearly the intent.

    You can theoretically construct the right to bargain collectively from the right to free association (1st amendment) and self-determination (declaration of independence), and of course everyone's favourite, the 9th amendment.

    It's one thing if the state passed a law saying "we will fire all union workers / we will not negotiate with unions". If that's how the republicans want to run the state, that's peachy, they can run it into the ground for a few years and then get turfed for hashing things up so badly. But passing a law saying "your union is forbidden from bargaining collectively, also we retain the right to break strikes through legislation" is pretty dangerous.

    I'm sure they'll still get 4/9 supreme court justices, no matter the argument. Go go dysfunction.

    If I was a republican or big business, I'd be worried right now. With the way the economy is as well as the constant outsourcing of jobs, emotions were a powder keg and Wisconsin managed to light the fuse. I wonder if this will spread to other states now.

    Listened to that Michael Moore interview on msnbc, that stat he brought up is crazy. The top 400 Americans have the same wealth as the bottom 155 million Americans, and it's getting worse by the year. How that happens in a democratic society is mindboggling, and totally unsustainable.
