NEW BEDFORD, Mass. (AP) — It's the big one that got taken away.

Massachusetts fishing boat owner Carlos Rafael was elated recently when one of his trawlers snared an 881-pound tuna.

The Standard-Times of New Bedford reports (http://bit.ly/uczYap) the tuna was likely inadvertently snagged as Rafael's crew set a net to catch bottom-dwellers. Federal fishery enforcement agents seized the fish when the crew returned to port Nov. 12.

Rafael had tuna permits, but was told catching tuna with a net is illegal. They must instead be caught with rod and reel.

A fish that big is hugely valuable — a 754pound tuna recently sold for nearly $396,000.

Rafael's fish will be sold overseas. He will likely get a warning and no share of the proceeds if regulators find a violation.

Rafael might give up his tuna permits, saying they're apparently worthless.

Groupon Deal Burns Small Bakery With Orders for 102,000 Cupcakes

The owner of a small bakery outside London claims she had to make 102,000 cupcakes when a deal she posted on Groupon took off online, according to reports.

Owner Rachel Brown offered a 75 percent discount on the money-saving website for 12 custom cupcakes, which typically sell for $40 and were available through Groupon for $10, the Telegraph reported.

Brown was prepared to fill a couple hundred orders, but when 8,500 poured in, her small staff at the Need a Cake bakery was inundated and unable to keep up with the demand.

Brown told the Telegraph she lost over $3 on each batch and had to hire additional help to fill the orders at a cost of $19,500, cancelling out a full year’s profit on the business.

“It’s been an absolutely nightmare,” she said in an interview with the Telegraph. “Without doubt, the worst ever business decision I have made.”

Groupon, the money-saving website which offers daily deals for as much as 80 percent off the original price, has soared in popularity since it launched in 2008. Now in 43 countries, deals are available for everything from dinners to dance lessons, weekend getaways, even medical procedures, and have meant big savings for online bargain hunters.

For businesses looking to expand in a tough economy, Groupon has been viewed as a way to reach new customers.

While Brown’s Need a Cake bakery, located in Reading, Berkshire, did attract a new clientele through the deal, she said the quantity of cakes she was forced to produce was detrimental to the quality.

“We take pride in making cakes of exceptional quality but I had to bring in agency staff on top of my usual staff who had nowhere near the same skills. I was very worried about standards dropping and hated the thought of letting anybody down,” she said to the Telegraph. “We are still working to make up the lost money.”

A Groupon spokeswoman told the Telegraph there was no limit to the number of vouchers that could be sold. “We approach each business with a tailored, individual approach based on the prior history of similar deals,” Heather Dickinson, director of International Communications told the newspaper.

That's what happens with these fucking morons who don't put a cap on the amount of groupons that can sell. Greedy idiots. The same shit happened with my friend's ex-employer (shitty photographer). She got a billion buyers for her groupon portrait sessions so she stopped answering her phone and refused to schedule people via email and when people got pissed and demanded their money back, she was happy to refund them just to rid herself of a customer. Total fucking retard.

    Tattoo Artist Facing Civil Lawsuit

    November 21st, 2011

Two trailer park residents in Dayton, Ohio are going to be battling this out in court over the next few months.

Tattoo artist, Ryan L. Fitzjerald was hit with a $100,000 lawsuit last week by his ex-girlfriend Rossie Brovent. She claims that her boyfriend was supposed to tattoo a scene from Narnia on her back but instead tattooed an image of a pile of excrement with flies buzzing around it.

Apparently Ryan found out that she had cheated with a long-time friend of his and this was his way of getting even. Originally Rossie tried to have Ryan charged with assault but it turns out this crafty tattoo artist got her to sign a consent form prior to the tattoo and it said that the design was ‘at the artists discretion’, she claims; “he tricked her by drinking a bottle of cheap wine with me and doing tequila shots before I signed it and got the tattoo”. “Actually I was passed out for most of the time, and woke up to this horrible image on my back.”

Man sues former hostages, says they broke promise
Topeka, KS- Can there be no trust between a kidnapper and his hostages?

A man who held a Kansas couple hostage in their home while fleeing from authorities is suing them, claiming they broke an oral contract made when he promised them money in exchange for hiding him from police. The couple has asked a judge to dismiss the suit.

Jesse Dimmick of suburban Denver is serving an 11-year sentence after bursting into Jared and Lindsay Rowley's Topeka-area home in September 2009. He was wanted for questioning in the beating death of a Colorado man and a chase had begun in in Geary County.

The Topeka Capital-Journal (http://bit.ly/skb0Rl ) reported that Dimmick filed a breach of contract suit in Shawnee County District Court, in response to a suit the Rowleys filed in September seeking $75,000 from him for intruding in their home and causing emotional stress.

Dimmick contends he told the couple he was being chased by someone, most likely the police, who wanted to kill him.

"I, the defendant, asked the Rowleys to hide me because I feared for my life. I offered the Rowleys an unspecified amount of money which they agreed upon, therefore forging a legally binding oral contract," Dimmick said in his hand-written court documents. He wants $235,000, in part to pay for the hospital bills that resulted from him being shot by police when they arrested him.

Neighbors have said the couple fed Dimmick snacks and watched movies with him until he fell asleep and they were able to escape their home unharmed.

Dimmick was convicted in May 2010 of four felonies, including two counts of kidnapping. He was sentenced to 10 years and 11 months on those charges. He was later sent to a jail in Brighton, Colo., where he is being held on eight charges, including murder, in connection of with the killing of Michael Curtis in September 2009. A preliminary hearing originally scheduled for Dec. 6 has been rescheduled for April 12. No plea has been entered in the case.

Robert E. Keeshan, an attorney for the Rowleys, filed a motion denying there was a contract, but said if there was it would not have been binding anyway.

"In order for parties to form a binding contract, there must be a meeting of the minds on all essential terms, including and most specifically, an agreement on the price," he wrote.

Keeshan said the contract also would have been invalid because the couple agreed to let Dimmick in the home only because they knew he had a knife and suspected he might have a gun.

    Oh Scientology
For most people, an extended stay aboard a luxury cruise liner sounds like a dream vacation.

But Valeska Paris says she was held against her will aboard the Scientology cruise ship "Freewinds" for more than a decade. During her stay on the vessel, she alleges, she was forced into hard labor and never allowed to leave the ship without an escort.

In an interview with the Australian Broadcasting Corporation's (ABC News) Lateline program, Paris claims that Church of Scientology leader David Miscavige sent her to the ship when she was 18 in order to prevent her family from pulling her out of the organization.

"I was basically hauled in and told that my mum had attacked the church and that I needed to disconnect from her because she was suppressive," she said. "He decided the ship, and I found out two hours before my plane left, I was woken up in the morning and I was sent to the ship for 'two weeks.' "

Paris was born into a Scientology family, but her mother quit the group after her husband committed suicide, blaming Scientology for coercing him out of a self-made personal fortune of more than a million dollars.

Instead of the promised two week stay, Paris found herself unable to leave the ship without an official Scientology escort and was often forced into hard labor on the lower levels of the ship for stretches as long as two full days. "It's hot, it's extremely loud, it's smelly, it's not nice. I was sent down there at first for 48 hours straight on almost no sleep and I had to work by myself," she said.

So, why didn't Paris simply escape from the ship when it would take port? The Freewinds has a relatively small sailing route, traveling throughout the Caribbean and occasionally docking at small islands.

"I did not want to be there, I made it clear I did not want to be there and that was considered bad ethics, meaning it was considered not right," she said. "They take your passport when you go on the ship and you're in the middle of an island. So it's a bit hard [to escape] and by that time I was 18, I'd been in Scientology my whole life, it's not like I knew how to escape," she said.

The Church of Scientology calls Paris' claims false but declined ABC requests to make church officials available for interviews for the story. The church, which has a well-known litigious history, threatened Lateline with legal action for taking part in an alleged breach of confidentiality between Paris and the church. In a statement, the Church of Scientology said Ms Paris' claims were false.

"She certainly wasn't 'forced' to be there. She was also never forced to perform labor in the engine room," the statement said. "The Freewinds is a wonderful place, as even Valeska said on numerous occasions. Her allegation that she could only leave the ship with an escort is totally false."

Every so often, a hero is born:

SEATTLE – A man who apparently decided not to silence his cell phone at a movie theater last week was allegedly choked by another moviegoer who was angry over the disruption.
It happened Nov. 21 during the 5 p.m. showing of “Tower Heist.” The Seattle Police Department redacted the name of the theater in the incident report, but published reports indicate it happened at the Majestic Bay Theaters in Ballard.
According to the responding officer, the victim’s cell phone went off a couple of times near the end of the movie. He checked to see who called him, prompting the suspect who was seated in the same row to yell, “Shut it off.”
Minutes later, the phone rang again. The victim apparently said something to himself. The suspect allegedly said, "Better keep your mouth shut."
At some point, the suspect left the theater twice, brushing past the victim’s legs.
When the suspect returned a second time, he allegedly walked past the victim then turned and grabbed the victim’s throat.
The victim told police it lasted for about 30 seconds and that he could not breathe.
The suspect then allegedly told the victim he was going to report it to the manager, but would claim that the victim was the one who committed the assault.
Two witnesses told police they saw the suspect lunging at the victim and putting his hands around the man’s throat.
The police report redacted the suspect’s statement to the officer.
There was no immediate word on whether charges would be filed.

A Frenchman has been ordered to pay his ex-wife £8,500 in damages for failing to have enough sex with her during their marriage.

The 51-year-old man was fined under article 215 of France’s civil code, which states married couples must agree to a “shared communal life”.

A judge has now ruled that this law implies that “sexual relations must form part of a marriage”.

The rare legal decision came after the wife filed for divorce two years ago, blaming the break-up on her husband’s lack of activity in the bedroom.

A judge in Nice, southern France, then granted the divorce and ruled the husband named only as Jean-Louis B. was solely responsible for the split.

But the 47-year-old ex-wife then took him back to court demanding 10,000 euros in compensation for “lack of sex over 21 years of marriage”.

The ex-husband claimed “tiredness and health problems” had prevented him from being more attentive between the sheets.

But a judge in the south of France’s highest court in Aix-en-Provence ruled: “A sexual relationship between husband and wife is the expression of affection they have for each other, and in this case it was absent.

“By getting married, couples agree to sharing their life and this clearly implies they will have sex with each other.”
