That's not really the argument here. The supreme court ruled that the funeral wasn't disturbed, therefore it couldn't fall under cholpinksky, as they didn't "breach peace", they couldn't be held under those principles.

My question is, if it's not a breach of peace, they why does the swat team have to show up to set up perimeters?

The way it's narrowed, and if you find me wrong, tell me, is that if it incites violence and breaches peace toward a private individual, then it could fall outside of the first amendment, although I think media may be exempt (result of Falwell).

Yeah, police are there as a precaution. Even if the demonstrators are peaceful, there is always a possibility that someone else might start shit. Large groups of angry/upset people can potentially get out of hand very quickly. Even worse when they are trying to provoke others who may not be quite so peaceful.

I think the biggest issue with fighting words is that you're defining intent. (not you personally lol, the concept)

According to these people, they're not out there trying to piss people off, or get them to react dangerously. If they legitimately believe they're out there saying these things in attempt to "save people's souls," the only way you can then argue that it's an attempt to incite a dangerous reaction is if you're claiming to know what they're thinking when they're saying something different... in an opinion situation.

And, of course, if you go down that route, then a pissed off redneck can make the exact same argument about, say, a gay pride parade.

But yeah, I agree. She's not very funny, but more power to her for this. The saddest part is seeing all those kids standing there protesting. I can't imagine what being raised by such hate mongers must be like.

I actually went to school and was friends with two of Fred Phelps' grandchildren. They were very different than you would imagine.

In school you wouldn't have known they had anything against anyone. They were very normall and even respectful teenagers.

Fred Phelps organizations originates from Topeka Ks. He was once a respected lawyer if you can imagine it. H ewas my mothers lawyer for one of her cases and she said she was not the man he was today, and that his organzations pretty much came out of nowhere.

They preach hate and it's disgusting but It really is bs too. They are not the hateful people they pretend to be, my guess is they are making of money off it. That's quite sad and I don't know any of them intimatley anymore, but when I was younger and friends with some of his family.. Bteween protests and all that hate stuff, they were a very quiet and nice group of people.

I'm being serious btw. Not defending them, but if you lived or gew up in the Topeka area. you'd know we did not take them seriously because Fred was already such a known guy at the point he started protesting, and out of nowhere. People thought he was crazy, and at that time he pretty much retired from Law and the public eye. When they protest in Topeka, it's really just everyone ignoring or laughing at them. They are attention and fame whores and its funny because if you meet them privately or goto school or had known them outside poolitics, you'd know its a bunch of bullshit.

Idk how they are making money off it, but they are incredibly rich. One of his daughters, is bat shit crazy when the cameras are around or if they are at a public event, and in social events, shes this delicate little flower. Its pathetic they resorted to hate to make a living, because they dont believe in half the bs they preach. It's all a show boat and they really should be ashamed of themselves. Theyre not evil.

Also, I wasn't even aware they were famous until I saw a movie with them in it called the Laramie Project. It was so bizaare to see them getting press after that because they had been such a joke in topeka that NO ONE took serious, and suddenly the nation is giving them all this attention. I mean, really.. Maybe it wasnt such a big deal to people in that area because everyone thought fred was just a loser who went crazy after he got some bad word of mouf because he screwed someone over in a case. Mom told me he screwed a client over and got in some real trouble, which is when he started this.. church.. lol
