Only dumbass prosecutors go with that bullshit angle and it usually results with the defense getting their guy an even lesser charge. I fucking facepalm as an investigator whenever JAG wants to come at me with that stupid shit, it's like dude just charge him for the fucking crime, don't make shit difficult.

How did hate crimes work in Army with DADT?
Never worked on one specifically for DADT to be honest but my team chief told me both parties usually end up getting reprimanded one way or another as fucked up as that sounds. We don't make the charges, we just investigate, give our case file with all our findings over to JAG and they decide the route for whatever article in the UCMJ they want to charge.

I am kinda ambivalent as to whether we should have "hate" crimes or not. I've often heard it as really just lolpress talk to get people riled up, but inside the courtroom it doesn't often fly. If Hiro is right though that those that do fuck up with it can cause lesser sentences then ya that's something that needs to be looked into. As others said, intent is important, but the intent of killing someone who's gay shouldn't be any different than the intent of killing your husband for cheating on you.
