Sorry if all this has been said before:

A certified mail that you have to sign/pick up from the post office is the ONLY way "real" lawyers send mail. Disregard if it didn't come this way.
If you want to be 100% sure, call your local BBB office (bbb.org) and fax/send the mail to them and they will evaluate it. Did the letter have a lawyers name on it? Google the name, and see what comes up, also BBB.org the name as well.
When I got a copyright infringement notice, my ISP turned off my internet and they sent me a message Via telephone, in which i called them back and "deleted" the stuff and I got my service back, not even one physical letter.

    Anyway, sounds like a scam.

Also, what is a private torrent site or whatever?
A private tracker requires you to have an account (usually on an invite-only basis) before you can connect and download content, usually even the torrent list for the tracker is hidden until you log in. Sites like Undergroung Gamer, BitGamer, and Blackcats Games do this, so that companies can't see what is up for download or who is downloading it. If they can't get a torrent file to connect, and the tracker to report the IP addresses of seeders and leechers, they don't know who to try to sue for damages. Since you can get banned if someone you invite doesn't behave on the site, you only invite people you know, and you know they aren't working for a company that would start a lawsuit. These sites also ban DHT on their torrents, so that won't spread a peer list to someone who has edited the torrent to try to run it without the tracker and a login.

His mom flipped all kind of shit. They aren't very computer savvy people so this was like OSHITWTF because of the monetary threats in it. I've told him repeatedly to just forget it ever showed up, and it being legitimate is next to impossible. Last conversation I had with him telling him to just ignore it a few days ago was this:
    Spoiler: show

Him: That's not what my mom is gonna wanna do. It says if we wait too long we could be facing 250,000 dollar fine 11:33 AM
Me: They have to take you to court for that fine, at which point you'll need a lawyer anyway. 11:34 AM
Him: Yeah but my mom is gonna wanna make sure that will never happen 11:35 AM
Me: Then get a lawyer.. there's nothing else you can do to make 100% sure... You googling old ip reservation addresses to try to prove you're innocent is useless 11:36 AM
    Him: Oh well idk..

Not much else I can tell him, they'll be fine.

Seriously i don't understand how this is even considered to be a legit letter. I would have immediately tried to contact the law firm and look into the case # to see if it's legit. I didn't even know about the certified letter angle, which saves you even more time.

If she wants to waste her money let her. I know abosolute dick about law but I know that unless they can prove you've received it, you didn't. The execeptions to this usually involve fee's where paying the 'shut the fuck up' fee is less than fighting it in court.

Talk to the mother, not the son. The son is probably getting screamed at a lot and not listened to very much. Give the woman a phone call and explain what you know. Parents will often believe a total stranger before they believe their own children when it comes to stuff like this.

Critics loved it, nobody bought it. I can't believe no one else heard about this stuff before. It was mainstream news material for a while.

9 times out of 10, suits like this where you get sued for something like infringement, etc. get settled in civil court. If you don't get a subpoena to appear in court (certified original with official seals and a sworn affixed notary republic seal on the front) then it's not anything to worry about. Everyone, even if the case is settled, has to appear before a judge before monetary damages can be collected (unless you're a company then you can pay out to people but people can't pay to you until so ordered by the judge deciding the case). You have the right to confront your accuser and to present a defense (even in a civil case though likely you're going to loose but that's a whole nother story).

The so called "evidence" these people can get can be viewed by you and your attorney including the "subpoena" that got them their info and you can see for yourself if the info is bogus (many times it comes to light that usually info of this nature is obtained illegally such as line tapping or a lawyer paid someone to leak some info from the IP) and they can be counter sued for their activity. Also, most civil defense lawyers will at least hear your case for free before you have to pay money. Most (if not all) will at least offer some legal council and determine weather or not you actually need a lawyer for your case. You can always say no and not sign the contract, or you can get one of those good national branch lawyers such as Sokolov or Brady who take pro-bono cases and will only collect if you get paid. If you don't get money, there is no legal obligation for you to pay them money.

Get the poor kid into a private tracker! Feel bad for the kid (being that it is more then likely fake) There is no real way to tell if he DLed the shit if its not longer on his PC. Odds are if hes not comp savvy there is not password on his router and for all he nos he may of very well had someone DL it off his net. I do this all the time when my net goes down, next door. also when I cant find what I want on my private tracker ill link up to them lol I wonder if they ever got a letter? Do have PeerBlock set to fucking everything though.

Demonoid is a private tracker, right? So I can torrent whatever I want from there and TimeWarner can't track it?

demonoid is poorly private. It's basically public compared to any good private tracker.

"Can't" is also misleading about any private tracker since it's not impossible that a company that reports on infringement could get an invitation, it's just less likely. Plus they'd need to keep a ratio lol.

Oh alright, good to know it's 'rarely' at least. If you guys do catch something, what's procedure? Cease and desist letter or something for first time offense?

Demonoid allows other trackers to be used with torrents on their site, and many are public trackers. As such it's not really private. You could modify the tracker list in the file before you start it to only use Demonoid's tracker, assuming it's not an external torrent.

I'd say Demonoid is a public tracker, you can even download torrents from them without logging in / being registered.

Ah, that used to not be the case when I signed up with them. They have an invite system too.

SOP is depends really on how much is downloaded to be honest. I normally quarantine the modems and make the sub call us so we can tell them why.
Happens again, we cut the account.
