    Melena, either tell them you are leaving your lease because they are violating the law (if you want to move) or ask for a half-month rent credit and call it even. If they don't want to budge on either of these (considering they've acknowledged the violation and have apologized, they seem to be in a concililatory mood), then consider court if you like.

    But at least ask for what you would like first before lawyering up.

    The property manager verbally abused and threatened my wife to gain entry

    Basically until I know more about the "abuse" and "threats" it looks like they made a mistake and went to the wrong building. Solutions to this problem would be:
    A. Let them the fuck in. I mean, holy shit, they just wanted to change the air filter.
    B. Tell them to get the fuck out. I'm not sure how threats work if you know they didn't give you notice.

    You're only going to get anywhere with this if you can prove that the landlord was actually abusive or actually threatening when he "threatened" your wife.

    Obviously your complex needs new management and you should do everything in your power to ensure your landlord gets fucked on his job.

    Pounding on the door, calling my wife a liar, threatening her saying she's breaking the law by not letting them in, claiming they sent a notice to everyone (and yet no one in our building had a notice) and them apologizing and saying THEY BROKE the law. If I was there I could have actually had them arrested under california civil code 1948 (i believe that's the code).

    Already did that. Ask for a one month free minus pet rent, and haven't heard a word in a week. Hell to get a $250 credit to cover my day off from work due to them flooding my bathroom I had to threaten litigation.

    Well, I wouldn't call that abuse. Seems like they made a mistake and went to the wrong building. You act like this place is just fucking awful but all you have done is try to get free rent as opposed to trying to get out of your lease.

    Edit: Don't get me wrong, I think you're right in this situation to be upset, but I don't think you should be going to court over something so frivolous unless they refuse to break your lease. If you just want to not pay rent then I think what you are doing is shitty and so far that's what it looks like.

    Well this is just the straw that broke the camels back. If they didn't cause several hundred dollars in property damage 3 months ago, wrongfully give us a 3 day pay or quit notice after we paid our rent and the check cleared, among many other things, lie to my face about trying to resolve this amicably, it would have never come to this.

    Well update. Since they didn't break anything, they told me to pound salt and that they don't owe me a dime. They also told me since my wife was home, no notice was needed which is bullshit and against the law. They basically admitted to me that it's perfectly fine to intimidate your tenant's all you want. Researching this company I found a few lawsuits concerning deposits, harassment, and various other things including one which looked similar to ours. Going to have to talk to the parental units about seeing if they can help us break our lease as well since we don't have the 2 months rent + deposit and moving costs to find another place. I'm usually a pretty calm person but I've never wanted to reach out and choke a bitch like I have this past week dealing with this shitty company.

    Still think it's spilled milk and you are asking for a lot...how the fuck would WATER ruin $300 worth of bath towels??? Why the fuck do you even have that many towels?

    Get it on tape. You can break your lease free-and-clear in California if you can prove that you're forced to live in a potentially unsafe environment.

    Also, I'm not entirely sure where they'd owe you money either. As you said, they didn't break anything of yours except maybe your wife's feelings. Just sounds like a business relationship that has soured and they're treating you as hostile towards their business, as any other business owner/operator would.

    They broke the law. They don't "owe" him money, but if he's going to lawyer up for something they've admitted to doing, it may be in their interest to settle instead of having to pay legal fees.

    Just got off the phone with a lawyer. She confirmed they did violate law. She also felt our demand for a month free and an apology to my wife was very reasonable. She advised to A: Send off a final demand letter letting them know that we are willing to settle, but that we have contacted a lawyer who advised us that we do have a case, so that's the next step.

    Also to answer the questions, we have that many since we are recently married and got a lot as wedding gifts. and it was enough water to seep under the rug, into the bathroom and pretty much cover the entire bathroom floor. So figure out how many gallons of water (that's also incredibly dirty) to soak up and have no way to dry or wash them since the coin op machines at our building require a special debit card you have to purchase from the office during business hours, which it wasn't

    I am not reading this right. You think that it should cost someone $1200 to yell at your wife?? 1500 - 300 (towels) ??

    How much would it be if your wife was being verbally threatened to allow the law to be broken, 4 days before a scheduled biopsy. After they already flooded our bathroom (how can I believe them now that if there is water damage they won't make us liable when they've lied to us before), falsely posted a pay or quit notice on our door for everyone to see, among a list of other issues?

    As far as the towels, nearest 24 hr laundromat? I'm just sayin...it completely sounds like you threw away $300 worth of towels that were given to you instead of spending $15 on washing and drying them.

    The harassment at the door also sounds fishy. Like there was something for you or your wife to hide and someone got defensive. Just fucking let them come in and replace the air filter. It's called being civil. Their mistake, your solution...everyone's happy.

    It's like you are searching for a reason to lawyer up and get a pay day. If you are the unhappy about your living conditions, you can make decisions for yourself. If you are just trying to get reparation, be civil and talk to someone. Making threats and demands all over the place does wonders in helping your case get shoved in the pile of shit that management has to deal with from shitty tenants. You are labeled and nobody wants to deal with you.

    It's human nature to get defensive when someone attacks you. It sounds like they are playing defensive if you can't get in touch with anyone. They can drag this out for years if you try to take them to court. Just try being nice and talking face to face with people.
