    Pretty much what Acevalefor said. Sounds like they are a shitty company and you wanna get back at them by taking their money.
    If I was the Management Company and he made those demands he would have got the same answer. Both sides Handled the situation poorly.

    Well again, honestly if this was the first and only issue, sure, i'd let it ago with just an apology. The manager apologized to me, but can't be bothered to apologize to my wife who was there? As well as her regional manager wouldn't even have known if I didn't call, even though she assured me she would call her. Archi is right, a lot of it is pride. And sadly sometimes the only way to get someone whose fucking with you constantly is to hit them where it hurts, and in this case here it's money. 6 weeks before my vacation and dealing with the fact the wife may have cancer (they have to reschedule the flipping biopsy after we showed up) the last thing I want to be doing is playing cat and mouse games with a company that has a longstanding history with other complexes they manage of screwing with the tenants. As it is when we move, we have to make sure we photograph every inch of the apartment now just so we can be assured of getting the majority if not all of our deposit back.

    As for hiding anything, the apartment was a mess and haven't had a chance to clean it due to work. Would you want people walking around your house when it's a mess?

    They broke the law, admitted it, he made a reasonable offer, they said instead "no it's your fault". For 1500 a month, even by big city standards, that is not something people should be forced to deal with. He can definitely win in court against them, and since he has had to bring a lawyer into this, it'll be for more than the previous settlement offer when it gets to that.

    Basically I told the regional manager I was asking for one month minus the pet rent, but was more then willing to negotiate something just to put this behind us. If they came back and said hey, were sorry, won't happen again, how does $500 off next rent sound I would have taken it.

    The vindictive person in me says vigilante justice is perfect. The whole thing sounds like, as Sparky said, it was handled poorly.

    Well I don't know how others would have handled it when it's been constant issues. If we had the money we would have moved earlier this year, but with the wife's hours getting cut, our savings got nuked hard till she found a new job. Won't be an issue for next year though. I felt I was more then fair though, especially when the property and regional managers both said they fucked up.

    i wouldn't be, he's paying $1500 a month, the least he can expect is for his apartment to not get flooded and his wife not to get yelled at by the people he's paying the money to.

    if he wasn't paying for this service i'd see your point.

    Not sure where you're talking about, but every place I have rented in NY has never had any of this. It is not the right of the land lord to be able to waltz into your house at any time. They can keep a key, but they are only allowed to use it in case of major emergencies like a gas or water leak where they need to let in the fire department instead of them bashing down the door to the place. The only time other then that that the landlord can demand entry is during an eviction and EVEN THEN, he has to have a police offer with him who serves the eviction.

    @The OP. You have a case if you can show proof he verbally abused your wife, did you get anything in writing in the form of an apology? Or any written or factual proof about the other screwups they have commited? Otherwise it will be your word against theirs, and if they are a rental company and not just a guy renting a property, they will probably win the case

    Remember to get documentation from herein in otherwise of everything that is said to you by them and all their actions. I once had a gas leak in a known leaking gas line in my apartment the landlord never told us about, I made sure that I had a written and signed document from the gas company who inspected it that it was there, and that it was obviously known as it had been tagged previously.

    Please stop saying they harassed and threatened your wife. Knocking on the door and arguing about rather they actually gave prior notice of the visit is not harassment nor threatening. Also, your wife let them in the house so I doubt they actually did anything legally wrong. They didn't enter without your consent. Obviously a mistake was made by management and they apologized.

    Stop thinking with your frivolous lawsuit brain, and start using your logic. They didn't do shit to you. You don't deserve any compensation because ZERO damage was done. Also, stop talking about the fucking water. You already said they compensated you for that.

    It's also funny that a while back some guy found a METAL WIRE in his soup and BG jumped on his ass about suing. Now somebody comes along and just wants a free months rent because some landlord wanted to change his airfilter unscheduled. LOL at this whole situation.

    So yelling through the door saying you are violating your lease if you don't let us in is not threatening? Well holy shit color me surprised. Hate to burst your bubble here, but talking to two lawyers (both who advised small claims as it would be low money) as well as the property itself admitted what they did was illegal. Don't know what's hard to understand about that.

    I'm not saying you can't sue for this. You can apparently sue over anything in California. The main problem in all of this is that you are just being a douche trying to get free rent instead of trying to break your lease. You don't want to move. You want money for nothing.

    Go to them with a list of all the ways they have wronged you and say you want to be freed of your lease. If they don't do it then take them to court.

    I did miss the part where you said you can't afford to move. Also, I'm not sure what makes you think I'm trolling. I, unlike some of the people in this this thread, just looked at the situation logically. Maintenance comes to change an air filter unscheduled and you want financial compensation. Now that its more apparent you are having money problems, I 100% see why you are doing this.

    That being said, if you can't afford to move and an apology isn't enough for something so trivial then I suppose your only option is to take them to court. I hope that if/when you get your money that you put it into moving instead of bitching 2-3 months later when they screw something else up.

    Didn't realize this thread got necro'd lol. We have no kids, but my wife at her previous job had her hours slashed from 30-38 a week down to 15-20 since JC Penny's is the devil, so for about 5 months while trying to pay off our wedding and some outstanding bills I've had, we had more going out then in. So we would have had to come up with rent for September, + First month and Deposit and moved in Oct. 1st. So all that to go with the places we found that were worth the price had either shitty layouts or smaller then what we had would have meant tossing out my computer desk and our couch and buying new ones. Now that the wife has a much better job with consistent hours, we're hoping to have enough debt paid off to qualify for a mortgage, or just afford a smaller apartment for a year.
