but back to the 10th amendment for a second. What are you trying to say? It seems pretty clear, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." What's there not to understand?

and people who use the 10th to say things like marriage equality should be determined by the states ignore the equal protections clause of the 14th amendment

i fully believe in it but it is consistently misappropriated in public discourse; it is not the be all end all amendment and when it comes to the protection of rights the federal government has every right to overrule state interests

I'm all for allowing the states to govern their own sovereignty, but when you have states with retarded fucking laws like these ones I draw the line and beg for the return of common sense.
