I really think the state of Florida did their job in gathering all the evidence before pressing charges. If they had arrested him on the night of the incident, it would have vastly reduced the time-frame in which they could gather evidence. Even with the police photos of Zimmerman, I am sure the DA felt there was a real case of murder 2/manslaughter. They won't charge someone with a crime just because the masses demand it. So there has to be enough evidence that says Zimmerman was not just defending himself.

Yeah. This isn't "new" evidence, it's just new to the press / us. I highly doubt the prosecution was unaware of this when building their case.

Burden of proof is on the state, really. If anything they should have to prove that he did initiate the altercation. He's the one being charged, he's not charging anyone.

The police really colored people's discussion of this topic by relying on the SYG law. Even if Zimmerman initiated the altercation by walking up and speaking to Martin, he did not lose his common law right to self defense.

Neither did Martin. There is a chance that the prosecutor has enough evidence to prove that Martin was acting in self defense when he attacked Zimmerman. 2 people can't simultaneously claim self defense against each other. Or can they?

And, I think what you mean to say is that Zimmerman never had a right to self-defense in the first place. I think you're imagining a scenario where Zimmerman runs up and says "wtf you doing", Martin is scared and starts beating his ass?
