    Marriage for citizenship (Not directly involed, no CS lulz, sorry)

    I have a friend from Korea and she told me a friend of her offered to marry her for citizenship (I'm assuming he just wants to tear that ass up, but just my assumption, etc.)

    Anyways, she asked me about it since she's an international student and pays a shitload more for classes.

    I'm not too knowledgeable of the subject, so looking for benefits vs risks so I give her good info, rather than something I pulled out of my ass.

    they dont get immediate citizenship upon marriage. they would get placed near the top of the list of new citizenship applicants and still have to go through the process. however this can still take years. a friend of mine married a canadian in 2008, and the guy is still working through the system. he currently has a long term visa until he finalizes his citizenship later this year

    If she is lucky enough, she probably will get the green card in few months. Then the real thing is just begin where you are going to wait for years before you finally can consider for citizenship application. Snprphx's friend should considered lucky enough, I knew some one who took 12 years before she got the citizenship, and her kids by this time already going to middle school lol...

    How about things that are associated with regular marriage? like if he racks up a lot of debt or something can she get screwed for it?

    Debt probably not the main issue. However, if she is rich enough, she would not even care to marry some guy to get the permanent resident, since she can just throw a million dollar into investment and she could get the PR right away.

    But if you talk about the tuition fee, there is no way to lower it even after you become US citizen lol. Since I'm believe the alien resident for any state status still applied, unless you been in US since your primary or middle school.

    My cousin became US citizen after finishing like 2 years of HS in the US and she paid $23/unit at comm college instead of $300/unit the int students at the college were paying.

    it's a pretty lengthy process. A good friend of mine married someone from outside the Country, I was asked to write an official document basically stating that they were a legit couple, talk about them together and my experience with it etc, it got filed with some agency. She also had to wait a couple years and then go through the process and take some test that probably most American citizens couldn't pass about the Country


    she have a green card? Think my friends wife got a green card quick but full /perm citizenship took much longer

    OOOOOOK.

    So I have personally been in this situation myself. I am Canadian, I married an American, and I tried to get in to the States. From the top shall we?

    First, I got in to the States to get married, but was only given a 2 week visa. We contacted some immigration lawyers who flat out told us to not get married and go for the fiance visa (K-class whatever). We said fuck it and got married anyway, cause of plans and whatnot. Because I wasn't in the mood to get fucked by USCIS, I left the day my visa expired.

    Three months later, I flew back, again with the intention of only staying for 2 weeks, but conversations with lawyers told me that because my visa wasn't a set time frame, I could just stay for the 6 months (tourist/visitor visas are for 6 months only unless otherwise specified). Immigration within the country is a lot easier when you're married. If you're inside and are married, you can file a couple of applications at the same time (SEND THEM IN THE SAME PACKAGE, NOT MULTIPLE, more on this later), and you basically have to stay until its done otherwise you start over. We intended to follow that route.

    Of course, I called USCIS a million times to make sure I was doing everything correctly, and was assured repeatedly that I was doing the right thing. We were living in Texas, and there is a center in Dallas (I think, I forget now). I made sure I was sending both of my applications there, and that they needed to go in separate envelopes. Sent it away, and waited. I called a few months later to make sure everything was going as planned and to see about a work permit. Turns out the instructions I got a bunch of times were wrong. To do the applications the way I was trying I actually had to put them all in the same one and send it to Chicago instead. Apparently they took my visa application and sent it to California, and sent my change of status application (which was rejected because there was no visa) to Texas. I was told in no uncertain terms that as a result of their shoddy instructions, I'd have to leave.

    My wife was nearly out of the Army, so I stayed a bit longer than I should have. I started to worry, so we packed up most of our lives and headed back to Canada. We got back here in December 2007, and with a bit of wrangling at the border, managed to make it in unrestricted. Canada is interesting in its protections, so as long as we were INTENDING to file, my wife would be allowed to stay. We didn't really want to go that route, because I had a cousin telling me that immigration to Canada was difficult and blah blah blah. We decided to go ahead with it anyway. While the process is certainly long, Canada is super easy to get in to, and my wife is now a permanent resident here.

    We again looked at going back to the States though, and yeah, its not simple. The process is fucking convoluted, and in some fucked up make-work initiative, they have processing centers for applications all over the country, and each of them is specific. My visa application was sent to my wifes mothers house, and we just let it expire instead of trying to complete it. Point of all of this is that marriage is no guarantee or way of simplifying entry and permanent residence to the US. There is still a prevailing opinion that marriage gives instant citizenship, and that simply isn't true any more, and hasn't been that way for a while. If your friend wants to marry, let him know that he needs to stick with the marriage for a long time (like 3-4 years minimum), and sham marriages definitely don't last that long. You need to commit to the process, as that is the only way to get in now. Either that or move to Haiti and hope for another earthquake or something.

    It's a long and complicated process, but it all depends on their current status. People whose lives are in jeopardy get priority. Then those couples who have children born here (assuming one of the parents is at least a resident, of course). I'd say visa students are way in the back. Damn immigration laws change all the time. They became ultra super extreme after 911. For better advice, tell her to visit her consul they should have all the info she needs.
