Today, as part of my curriculum, I am teaching a lesson to actual students for the first time. I know I'm prepared, but I'm so nervous. Holy crap.
Two Fridays ago a guy started an accident at a red light, slamming the guy behind me into me and me into the person ahead of me. My car and the front car were drivable and and my damage was to my trunk and right front headlight. Police come and declare the first driver at fault for everything.
Speak to his insurance and they of course said they'll cover everything including the rental car. So last Thursday I drop it off at the body shop they requested and got a rental. This morning I call to check on the status, they tell me it's still in work because the insurance company is balking at everything. Apparently cost thus far is at 5700 and rising.
I call the agent to see what is going on. He tells me the cost is too much for what they feel the damage was. I argue back with your driver hit me. All I want is my car back to the shape it was in just prior to the accident. He tries to throw on they only gave approval for a rental for 6 days so anything else would be out of pocket, so I have to again argue with how he told me everything would be covered and I only would pay for the gas on the rental and that insurance and no other costs.
We get off the phone after he said he's gonna call the shop again to try to hash everything out. I just want my car back, I'm tired of driving this tiny Fiat rental enterprise gave me.
Health Insurance increased and my job couldn't switch in time. Stuck paying fucking $250/WK for this month for health insurance I never use. NY fucking sucks for health insurance let me tell you that....

So you went to a shop their insurance company suggested..... and now they are bitching at the cost lol? Fender, maybe headlight, and rear bumper damage shouldn't be anywhere near $5700. But that is their issue to clear up with their body shop. The rental of 6 days means nothing. All they do is extend the coverage once the 6 days are up. They are legally responsible to cover a rental car for the length of time needed to repair the car.I call the agent to see what is going on. Also, why are you dealing with their insurance directly? This is what you pay insurance for in the first place. Let your insurance company hash it out with theirs and get everything settled.
Ksandra- yeah I took it to their shop once I called Honda to make sure it wouldn't void my warranty in anyway. And their paying all the damage because the officer deemed it the drivers entire fault at scene because he admitted to the police he was texting and driving.
Quixon- I honestly don't know why it's so expensive. The damage didn't look that severe to me. The trunk was dented in and wouldn't open. The front damage was to the light fixture and a little fender damage. I was expecting it to be at most 1500 in damages. Just spoke to my insurance and they told me they'll handle his insurance and try to get them to speed this process up.
I am going to guess this has to do with them trying to get around not paying for the frontal damage.
Technically, it doesn't matter if he was texting, you still should be at fault for the damage to the front of your car and the back of the car in front of you.
You are always supposed to have enough space so that if you get bumped you won't bump the car ahead of you.
But since the officer gave him 100% fault, they are just trying to weasel out of w/e money they can.
At this point did you call your own insurance company? Usually they will handle it for you in these types of situations, because if the at-fault guy's company won't pay, then your company would need to pay and they won't want to do that either if the cop said you weren't at fault.

Insurance companies are awesome at dicking consumers around. That's we hire......well insurance companies..... to keep the process going smoothly.
Take it easy and enjoy the rental for the next couple days. Make sure the body shop is NOT using refurbished parts. Make this known to them verbally, and ask for confirmation paperwork stating the repairs were done with NEW OEM Parts.

So much fucking this. Insurance companies fucking suck..whether it be auto or medical , etc. Don't let them fuck you over from this. I hope things work out soon.
My fail : Speaking on insurance Kaiser is apparently incapable of understanding for last two fucking years I have dual coverage..so I just love receiving a bill for $1500 that I know hasn't been billed properly. The only facility that I have been to that even acknowledges it has been at Santa Clara for my MRI - which if I lived closer would go there exclusively. Best Kaiser facility in terms of people/professionalism/attitude and handling I have dealt with.

Wait, what? Have you ever been hit from behind? This "rule" is not even plausible. Energy transfer and all that. A 7,000lb truck hitting a 2,000lb car at any speed greater than idle is going to force that car to move. Hitting it at 20+ and it will move a LOT.
When I got hit, I was driving a tahoe. I got hit by a little honda. The impact destroyed the front of his car and still had enough energy to push my tahoe forward and to the side 25~ feet. His car then hit the truck in front of me as well. 40mph impact.
Isaac, don't deal with the other driver's insurance. Have your agent take care of the details. If there is trouble, your insurance will pay for it and go after the at-fault driver at a later date. His insurance company also cannot force you to use any certain repair shop. Having a network of "approved" shops just means there is a bit of quid pro quo and other shady business going on between the repair shop and the insurance company. Quixon's suggestion to make them use new OEM parts is great. It puts a wrench in their scheming to charge premium, new prices for old rebuilt stuff.
Unless things change, I specifically remember this being brought up in drivers ed, that even if you are rear ended, if you get pushed into the car in front of you, you can be held liable for your front end damage and the rear damage of the car in front of you. It's bullshit, but yea.
Note also this is in california, your laws may be less retarded.
The examples he used were 20+ and 40+ mph. Typically when you're held liable being the middle car in a 3 car mva, it's at a stop light or intersection and the speeds aren't nearly that rate. You aren't always held liable, but you can be if you're way too close.
A good Rule of thumb is you need to be able to see the bottoms of the tires of the car in front of you touching the pavement, fire and EMS use this rule because it allows them the space to get around you if a call comes in.
