    I think the fact that he shot him does that.

I bet the kid could grab the gun from his chest and open fire faster than the cop could unholster his gun and return fire... so it just seems like the cop is going into the situation with a disadvantage and relying on his verbal communication to get him through it all. I think that's what the people upset about cops want

    Demanding you're more in control of the situation in terms of fire power, I think, gets you perceived as a thug, caveman, idiot, etc. Rather, having the communication skills to willingly go into situations disadvantaged and relying on communication skills to keep you on top of things is great for PR with the people overly upset about cops

    and even though I disagree with you, Neph, I think it's real cool that you keep on posting even though it's like 20 vs 3-4 lol. I keep coming back to read. Cheers

    You are allowed to own firearms so long as you are not a convicted felon. This also does not give you the right to open carry. In california there is a form you must fill out, which is then reviewed by your county sheriff who has to approve/deny. I believe you are also required to partake in gun safety classes. All that, to carry an UNLOADED firearm. An officer if seeing you open carry has the right to inspect your gun to ensure it is not loaded, and you can/will be arrested if it is loaded. Rules vary by state, but I know California has some of the strictest open/carry laws in the nation. You have to prove there is a reason for you to open/carry.

    That's not how it works hey.

    And I'm not saying that he should necessarily be charged. However, I fear that police departments in general do not draw a distinction between "you were within your rights to shoot" and "shooting was the right thing to do in this circumstance" - and I see this case falling squarely in between those two stances.

    The difference is still whether or not the firearm is in his hand and he's brandishing it. With it being in your waistband, it adds an unknown given the nature of the call. So in reality, cops don't just cap you because you have a firearm which is obvious with open carry videos. It's about the nature of the call, the intent of the accused, and his actions at the time of the incident. If you look like you're about to shoot, you're dead.

    I wish I could remember the exact wording of the law, but there's a loophole in california where certain classifications of long rifles are allowed but not others. There was a huge controversy over it due to some people protesting for full open carry without a permit carrying rifles around a shopping mall where I live.

    It's amazing to see the number of apologists who are saying it's OK that we should live in mortal fear of cops.

    I don't feel people should have to live in fear of cops. I'd love to see every dirty cop locked up. But I also believe that just like everyone else, proper protocol needs to be followed for discipline. We had a situation a couple years ago where one of our deputies was arrested when he arrived for work, ex girlfriend claimed rape. Sat in jail for almost a year before the wife admitted she fabricated everything cause she was mad he dumped her and wanted to get back at him and ruin his life. Thankfully he was kept on administrative leave while on trial so he had a job to come back to and back pay, but even with the false allegations, his career is still fucked.

    ROE is dictated by your environment and who's current OIC. You forget ROE can be "Shoot to kill with extreme prejudice" at a moments notice.

    I dunno, from my experience, not being a straight up fucking asshole/idiot the second someone from law enforcement pulls you over/walks up to you etc goes a long way. A Yes Sir/Ma'am No Sir/Ma'am when asking questions will be a lot more effective then fuck you.
