They have a pretty good chance and, according to NPR, the way IL law is written, the defendant is on the hook to defend himself unless he wants to try to say it was a lesser degree of murder. The jury can decide to make a lower charge stick too.

I watched the video. The kid was down and was clearly no longer a threat considering he was twitching and spazzing after the first shot. The remaining 15 shots were done execution style. Watch the concrete dust from the bullets ricocheting off the road. Also, the fact that the department deleted video footage from a security camera speaks volumes about his guilt. He done fucked up but maybe not premeditated fucked up.
