this shit takes like a year to get done(depending on the state) we wont no till way late this year I bet.
I no far to many people who got a dui. Always took like 3+ months with someone I no taking over a year. 21st birthday got pulled over; week after 22nd birthday he was given his verdict.(another week after that he was told what he had to do)
was reading the SC law, and found this:
Administrative Penalties
First offense DUI carries mandatory administrative license suspension of six (6) months, unless otherwise successfully contested in an administrative hearing
does this mean if convicted in court, and the DMV is success will I keep my license? The officer told me he would not attend the DMV hearing because it's a waste of time, and I would likely get my license back.
I bet he's mostly banking on you to pay the fines and admit guilt electronically. If you contest or go to trial, he'll more than likely get a caidence to appear. Then most likely he wont miss it, unless they have lack regulations in their department. I know if i ever FTA a court appearance in my department, its a reprimand that will never go away. A court can reduce the suspension of a license in lieu of so don't read too much in to what's written in to law. There's always one way you can interpret the law, then there's another way that could be totally different. And usually the court is the one who looks at it some other way.
I'm just trying to find a way to keep my license if convicted(not even sure if this is possible), after trying to find information the hearing itself for hours now, It's been impossible to find any kind of solid answers I know the hearings are two seperate from each other (court is the criminal part jail time ect) and the DMV has the license part. The officer had told me he would not appear, and was even telling me the best options while booking me and shit (telling me not to take the urine test, and to request this hearing just because he wouldn't be there) I have no idea why or even if he was acutally trying to help, he did seem like it though. I just about got the max fine possible for both first offenses (997$ DUI) (657$ Possesion) everything is paid in full. My next event to occur would be the court hearing on May 8th which looks like I will be represented by a court appointed attorney.
I'm gonna go meet with him in the up coming week and see what he has to say, and go off of that. If he suggest I plead guilty and tell the truth I will but, after talking to a few paid lawyers all have recommended not to plead guilty and simply explain the situation about my job and the belief that I was not under the influence, they believe I have a good chance to get it reduced due to the facts; 19yrs in age, 0 criminal history at all.
Just a recap of what happend:
Pulled over for speeding 60 in 45. ( no speeding ticket issued )
below are both misdemeanors in the state of South Carolina
1. Ticket issued for DUI 1st
2.Ticket issued for Simple Possesion 1st
Had small amount of marijuana (0.3g?)
Cop smelled it requested for me to do field tests.
informed the officer that it was my first time getting pulled over was nervous ect, (had just got my license 3 weeks prior due to it being for my new job)
failed tests. (nervous shaky,) I felt I only failed the walk the line part where you put one foot in front of another. My legs were pretty shaky.
Did breathalyzer test (0.00)
refused urine test (automatic 6month suspension)
informed to request DMV hearing due to him not attending/caring about it ( he said: "I will not attend the hearing because it's a waste of time and I don't care about it, because they will give your license back anyways this throws up some flags to me as why he would say this)
arrested transported to county.
Yes I know I fucked up big time, and have no problem facing the consequences if convicted I did break the law.
still my question is: If the DMV hearing is in my favor and I win, will I keep my license with a DUI conviction in court?

Get some ozium to spray or a pack of cigs to lite after you smoke in your car fool. cigarettes or ozium pretty much overpower most smells and its always worked for me.

Current DUI laws are broken. Got hit up with a DUI 3 years and that shit fuggin wrecked my world.
Um I think that is the point. Not for anything but drunk driving is stupid. Odds of killing someone else are higher than killing yourself.. 5 years that shit drops off. Really are to easy on people if you ask me in some states.
And no, I I don't no anyone killed in an drunk driving acedent. In this case being high its all the same.. I love to drink too, but but stay home or at the bar(or take a cab for like $4 a person. You paid that much at their for a single drink... There's zero reason to get a dui.
Definitely varies from state to state. My experience from getting a DUI in FL was pretty terrible. Very hard lesson as I wasn't driving, but passed out in my car after getting hammered at the bar.
No priors, great record, worked for a big company respected in the city, etc. License was suspended for 6 months, restricted 3 months, DUI school once a week for a month, attend an "impact panel" viewing about drunk drivers and the effects on peoples lives, piss tests once a week. 50 hr community service, counseling once a week for 2 months, fines + lawyer about $6k not including insurance tripling and also some state fund you have to pay for the next 2 years.
My lawyer prolonged my case, which pissed me off something fierce, and really didn't do shit, but the one thing I didn't get hammered with was being forced to carry the breathalizer in my car, which besides being a pain to operate is expensive.
Get a lawyer and pray.
