    (a)(1) HARASSMENT. A person commits the crime of harassment if, with intent to harass, annoy, or alarm another person, he or she either:

    a. Strikes, shoves, kicks, or otherwise touches a person or subjects him or her to physical contact.

    b. Directs abusive or obscene language or makes an obscene gesture towards another person.

    (2) For purposes of this section, harassment shall include a threat, verbal or nonverbal, made with the intent to carry out the threat, that would cause a reasonable person who is the target of the threat to fear for his or her safety.

    (3) Harassment is a Class C misdemeanor.

    This is true and it's also true here in D.C. but we have to have a complainant. Person has to feel like they were being intimidated, the cause of the behavior, etc. Disorderly is quite possibly the hardest crime to prove in court and 9 times out of 10, the person doing the act is a MO case anyways. But yeah my bad on overlooking that.

    Technically yeah. Forgot which case it was but there was a ruling stating officers have to have thick skin and can't lock someone up just because of abusive language or gestures unless there's other circumstances. If that were the case then officers would never rest as merely driving down the street nowadays gets you middle fingers, "fucking pigs" shouted to you, and the like. There's one street down in the business sector you can't drive down because there's a homeless dude outside that will purposely run out infront of a cop car just to get hit. He even said he does it just so he can get paid with the resulting lawsuit and that he hates cops for ruining his life.

    Forgot the littering but... meh. I don't think I've ever written a littering ticket. Dumping oil down a storm drain perhaps. But never littering.
