Basically if your employer tries to claim a 1099 after not paying your payroll taxes, he's claiming that you're an independent contractor and that you are liable for your own taxes. For example, if you were supposed to be paid 40 grand a year and you lost 10 grand of that to payroll taxes, if your employer files you as a 1099, you really only technically got paid 30 grand that year. You would then be liable for that other 10 grand, meaning you only really got paid 20 grand after taxes. He either has to pay the IRS or you, but if he's paying neither then he's stealing from you.

the other side of that is that if you have a 1099 you can literally expense everything if you create a receipt for it. trick I learned from a mutual acquaintance of ours who has knowledge in making a great deal of money independently.

what if you already expense to the company, likely hood of getting caught doubling up on expenses?
