Youre saying that having sex with a drunk person is rape because that person is no longer of capable of making a rational decision due to the impairment of their judgement, right?

How come this doesnt extend forth towards the following:
Drunk person driving their car
Drunk person robbing a house
Drunk person doing anything illegal

If the belief that a drunk person's consent to sex (while not under duress or any threat) is invalid due to impaired judgement, then this impaired judgement should carry forth to all aspects of a drunken idiots potential wrong doings, and not just apply to a drunk (BUT COHERENT AKA NOT PASSED OUT AKA NOT NEEDING 3 PEOPLE TO KEEP HER STANDING) female and her vagina.

Being drunk isn't a defense to any crime, including rape. I'm not sure what your point is.

The guy is now labeled a rapist. He will go to court, and will most likely lose. He will spend a couple years in jail (which doesnt take kindly to rapists as far as I know), quite possibly be subjected to chemical castration, and if he gets out of jail alive, he has to live with the rapist title for the rest of his life (he's not going to land a good job, and he's not going to get a girlfriend), all because some girl regrets having sex with him, sex that she consented to, and only regretted the next day.

Meanwhile, in due time the pretty girl who took one too many shots of tequila is probably going to get over her decision to sleep with an ugly guy with a 4 inch dick. Will she do it again, maybe, maybe not, but her life is not over, unlike the male, whos life is over.

saying you give consent to have sex is not a crime
being drunk and saying you consent to having sex is not a crime (but it's not consent)
robbing someone is a crime
being drunk and robbing someone is a crime
fucking someone who cannot legally consent is a crime

An excuse for what? Assuming the guy in question was not drunk, she hasn't done anything wrong. She doesn't need an excuse. If he was drunk, then no, being drunk is not excuse, and she is just as wrong.

I've been in the false rape accusation spot before. Nothing came of it because my phone was full of things like, "Can't wait to get you inside me" and "Omg last night was amazing, can you come over tonight?". Turns out she was embarrassed and told her friends she had no memory of sleeping with me and I must have taken advantage of her. I only needed to show the texts to clear my name but it doesn't change the fact that she could have ruined my life over her petty embarrassment. Also we were both drunk so according to this thread I guess the rape was mutual?

If you don't like that, and don't want to risk them deciding you took advantage of them once they sober up, then there's an easy solution: don't have sex with drunk people.

This is an excellent argument for not having sex with girls who consent to said sex while drunk. I'm glad we're on the same page finally.
