Yes, stopping the most terrible murders first would be the best way to proceed. Obviously we should eventually proceed to stopping all murders, but stopping the "tortured an entire family to death for no reason" murders should take higher priority than the "shot someone who tortured an entire family to death" murders.

I think it's good that there are degrees of rape and degrees of sexual assault. While I think it's ridiculous that, for example, forced anal penetration with a penis is not legal rape in many states (just legal sexual assault), otherwise I think the gradations of severity that the "degree" system has makes sense. Regardless of degree you still have to be a registered sex offender, which is a harsh punishment in and of itself. I think you'd be hard pressed to find people who would rather be forcibly penetrated by a penis than by a finger, for example.
