I apologize for not responding to this, but you'll have to forgive me. The thread blew up overnight into a 40 page shitstorm I more or less refuse to read. I only caught this because I searched for my username in quotes.
The extent to which I've argued that motive is essential in the ascertainment of guilt is broad enough to render it self evident. In particular, take the case of murder. Murder is a cause of death. What distinguishes it from other causes of death is the active agency of an assailant, and that active agency is further categorized to render distinctions between murder in the 1st and 2nd degree, plus manslaughter (which is technically not murder). That is, the distinction is predicated on intentionality or motive. A discussion of motive then, is essential in making an ethical distinction between cases of murder and cases of accidental death, say.
More simply, if I run over someone at an intersection then it's murder if and only if I intended for that person to die. Thusly is murder defined.
Indeed, the claim that one is the victim of violent crime is necessarily also some sort of positive claim about the agency or intentions of the purported assailant, for otherwise there is no way to attribute criminal responsibility or distinguish between accidents and criminal acts.
By itself this doesn't mean that hate crime legislation is a good idea, partly for the reasons you've described. I didn't mean to say that the merits of such legislation were not to be disputed, but rather this fairly basic point in ethics I've discussed.

On transgendered lesbians: sexual orientation and gender identity are two completely different things. There can be mtf that are attracted to men or women. A mtf who is attracted to men is "straight", mtf attracted to women is a "lesbian" and definitely not heterosexual.
