Not by itself. The result of an action doesn't determine the degree to which the crime is heinous, which is why for example, when the schizophrenic son of a scientologist mother, after carving apart his mother's body with kitchen utensils, which was seen to be a result of his being denied psychiatric care and medication, was not convicted of murder. The motive of the perpetrator, and in particular, the degree to which he or she understands the gravity of the criminal act committed, determines the guilt. Mens Rea, and all that.

This isn't really up for argument. It's how all criminal justice, and most sensible ethical philosophy works.

Having put that up on the table, the argument for hate crime legislation is that it takes a special kind of moral bankruptcy to commit a hate crime, which at first glance seems reasonable, since there is a clear difference in motive (which determines guilt!). There's also a bunch of bleeding heart post-modernist social justice rhetoric which is easy to make fun of. But if you really want to bitch about hate crime laws, you have to account for the first premise.

If you're upset by your absence of privilege then stop choosing to make your life harder. It is 2012. You say you didn't choose to be the way you are but you now have the choice to thanks to modern science. The minority group you hold so dearly, LGBT, note the T, as in transgendered. Just have a quick sex change accompanied by hormone therapy and if you're white female now you'll end up a white male, and get all that sweet privilege.

And you can still pursue your sexual preference of women. You may be cisabnormative but I don't think anyone will notice until it's time to de-robe and by then it won't matter. Your privilege will remain in tact.
