I have no reason not to believe him, outside of "SE wouldn't tell any stinking gaijin anything" logic, which may or may not hold up here.
He didn't even know that legacy would have no bearing on beta access.
He misspoke when he said legacy. He was referring to people who bought the game vs. people who haven't played 1.0, which is essentially what the rest of us were saying in how it would be stupid as hell for SE to prioritize those who haven't even played 1.0 and truly know what was wrong, over those who have.

Yes, even magic. 2.0 will teach players to use actual magic in real life. No smoke and mirrors. A disclaimer will run before the game warning players not to destroy their computers or homes by using Thunder inappropriately.
