If you've been drinking, and you get pulled over, and the cop asks "have you been drinking?"
The answer, 100% of the time, is "No Sir."
Don't give them a reason to field sobriety test you or breathalyzer you. There's no additional penalty for lying if you get caught anyway.
This. It also goes for any time you are pulled over. "Do you know why I pulled you over?" "Do you know how fast you were going?" The answer is always NO with absolutely no elaboration. You do not talk to them other than simple yes and no answers.
That being said, it's not advice to be a total fuckwad to the officer. You did something wrong. Accept that but do not give the officer any more ammo than he/she already has. He/She will use anything you say against you.
Always ask why you were pulled over as well. I got out of a ticket this past weekend because he tried to bullshit with me and we ended up going in circles until I finally got his shift supervisor out there. Supervisor was pissed that the rook screwed it up, apologized, and sent me on my merry way.
Edit: Point being, they have to have a reason. They can't just pull you over on a hunch.
A thousand million times this. Buddy and I got pulled over racing after we left the bar. Cop asks him if he's been drinking, he says he had "one." Had the field sobriety test, passed even though he forgot the letter V. Cop comes to me asks the same question I say no, no test, nothing. You NEVER give the cop any reason to give you the test.
I cannot help but laugh on the "don't do anything to get caught!" mentality in here. How about just not fucking driving if you have been drinking that day? How about that? Can we do that? Can we put on the big kid pants and not endanger other people because you are an irresponsible lazy fuck?

I would like to point out that most cops ask questions like that to see if you have some kind of excuse as to why you were driving so fast/crappy/slow/retarded. Sometimes it's a simple "Man I'm sorry, I just got off a double and yadayadayada" and it gives the officer the ability to make a judgement call. Simply clamming up, being difficult, baiting the officer, etc. will cause you to get scrutinized more. Most cops who relent or get tripped up by someone else are either 1. Not confident in themselves and their knowledge of the law or 2. Will just simply brutalize you.
Also don't give them a reason to breathalyzer you? 9 times out of 10, I knew I was going to do it before I even approached the window. I knew exactly how fast you were going, what traffic violations you committed, Best/Worst case scenario, and what I would charge you with.
Suspicion of DUI can be many factors. One big one most people forget: the smell of alcoholic beverages. Especially during the winter when you have all the windows up and no air circulating through the cab of the vehicle. It's on your breath, it comes out of your skin, it bleeds out of you when you sweat. Just that alone according to NHTSA and the DoJ gives an officer PC for a DUI stop (initial stop from the traffic violation or whatever excuse they use to pull you over then it turns in to a DUI investigation). Glassy/red eyes, inability to focus, slurred speech, profuse sweating when there would be no reason to, clammy pale skin around the mucous membranes (eyes/mouth mostly). Could be something else, yeah but have to rule out the DUI portion before investigating a potential DWI or medical emergency.
It's too bad the OP doesn't live near D.C. I could recommend a fucking fantastic, slick, and completely dirty lawyer who could get you off no problem. I've met the guy several times in the court room and thought he was just plain sneaky. Would use every little corner and loophole to get his clients off. Got a kid that was popped for Carrying a Deadly Weapon (Gun) and Assault with a Deadly Weapon dropped to simple possession of an unregistered handgun and simple assault. Judge gave him 30 hours of community service. Never would have known who the guy was if my wife's brother didn't need hire him and brought him to a family dinner once. Imagine my surprise when his ass walked through the door. Got my brother-in-law off of a reckless driving charge though. Didn't even have to pay court fee's.
