I'd kill for some waffles right about now.
Damn 30 years for armed robbery?
That article presented two very different sides - one of them indicates the kid got shot in the chest as he was approaching the CCW dude, and the other suggests he was shot in the back while running out the door. It's very, very easy to determine which of these is the reality, but that wasn't presented. I hate shitty journalism.
If he was shot in the back while trying to leave the business, then his body would have been in the video clip the news provided.
Also, fox news etc...
I'm not seeing why you think that jmc - a conservative news source is more likely to downplay situations of CCW misuse than anything. They're the pro-gun folks.
The major media outlets have long turned from journalistic accuracy to news entertainment. Fox isn't so much pro-gun as it just pukes out news that sells to their main target demographic of Republicans who consider pro-2A a party platform.
Since the act was deemed a clear and legal use of SD in criminal court I don't see this civil suit doing well. "Yes he was armed, yes he intended to rob the place, yes he pointed his firearm at someone with a CCW, yes it constitutes imminent threat to life, BUT HE DIDN'T HAVE TO DIE!" is a shitty justification for a wrongful death lawsuit.
Edit: On further scrutiny South Carolina law provides civil immunity if deem a legal use of SD under SECTION 16-11-410.

his video and a partial transcriptThe gunman who killed six people and died in a mass shooting near the University of California, Santa Barbara, has been identified by an attorney representing his father.
The father of Elliot Rodger confirmed through his attorney, Alan Schifman, that his son was the gunman. The 22-year-old was being treated by multiple therapists and was a student at Santa Barbara City College, said Schifman.
Schifman said that Rodger’s family was “devastated.”
“They want to send the deepest condolences to all the victims' families involved at this time,” he said.
Seven people - including Rodger - were killed and another seven people were injured in the shooting in the Isla Vista neighborhood Friday, said Santa Barbara County Sheriff Bill Brown, who repeatedly referred to the shooting as a planned mass murder.
"It’s just unfortunate that these kinds of circumstances occur," said Brown.
The gunman crashed his car after exchanging gunfire with deputies, said Brown, and was found dead with an apparent gunshot wound to the head.
It's unclear if police shot him or if the wound was self-inflicted. Police also recovered a semiautomatic handgun from the gunman's car, said Brown.
Concerns Over Rodger's Well Being Reported
Schifman said in recent weeks that Rodger’s parents were concerned for their son's well being and reported his disturbing YouTube videos to police, which lead to an investigation. According to Schifman, police interviewed Rodger and found him to be “polite and kind.” He did not specify which law enforcement division conducted the interview.
A social worker also contacted police about Rodger last week, said Schifman.
The YouTube posts include one titled "Elliot Rodger's Retribution," which Schifman called "extremely disturbing." In the video, Rodger sits in the driver's seat of a car as he promises "retribution" and discusses his "loneliness, rejection and unfulfilled desires."
"Girls gave their affection and sex and love to other men but never to me," he says. He adds that it'll be his last video.
Schifman said Rodger was diagnosed as being a high-functioning patient with Asperger syndrome and had faced bullying through much of his life as he had trouble making friends.
Rodger's father, Peter Rodger, is a film director who was the assistant director for one of the the “Hunger Games” films.
Witness Call Shooting Chaotic and Surreal
Witnesses described the shooting to ABC affiliate KEYT-TV as chaotic and surreal, with many in the crowd mistaking the gunfire for fireworks. One man said that he saw shots fired from a BMW, fatally hitting one woman and critically injuring another woman.
"I heard shots, scream, pain," Michael Vitak said. "All emotions. I hope she is going to be fine."
Sierra Swartz told KEYT-TV that the suspect fired at her and that she initially thought the pistol was an air gun.
“Before I started walking the other way he just lifted it up and … he shot and I felt like I just felt the wind pass right by my face,” she said. “I went to a random person’s house and I just ran inside and I was like ‘Honestly, like someone just shot at me.’”
Bystanders said that crowds of people ran from the area and looked for shelter after the shooting started.
“All of a sudden a bunch of people just started running into the store and we were all like ‘Just take cover, take cover,’” UCSB student Cayla Bergman told KEYT-TV. “It was really scary so all of us just called our parents.”
Mike Hassan, owner of a deli where one person was shot, said the incident was the “last thing” he would have expected in the neighborhood.
“I still [do] not believe it … Even [though] I seen it in front of me,” said Hassan.
The University of California, Santa Barbra, released a statement Saturday morning addressing the shooting.
“Our campus community is shocked and saddened by the events that occurred last night in the nearby community of Isla Vista,” read the statement. “Our thoughts and prayers are with the victims and their families who are grieving and mourning as a result of this tragedy.”
The university did not say if any of the victims were involved with the school in any capacity.
The victims' identities were not immediately released. Brown said the injured were being treated for gunshot wounds and traumatic injuries, including at least one person who underwent surgery for life-threatening injuries.

jeez this was a few minutes away from where i liveNORFOLK -- Three people are dead, including a police officer and a 17-year-old boy, and another officer is wounded after a seemingly random shooting spree in Norfolk. The shooter was killed by officers during a struggle.
Mark Rodriguez, 17, was shot and killed in his vehicle by 29-year-old James Brown, according to Norfolk Police Chief Michael Goldsmith.
Police say Brown was shooting randomly from his Jeep on Chesapeake Boulevard around 11 p.m. One of the bullets hit Rodriguez, who was sitting inside his vehicle. Rodriguez was pronounced dead at the scene.
Chief Goldsmith says Rodriguez was "in the wrong place at the wrong time."
Police responding to that incident, including 35-year-old Brian Jones, found Brown's vehicle near his home in the 7400 block of Wellington Road. Shortly after, an off-duty officer, 28-year-old Curtis Allison, came to assist. Police say moments later, the suspect began shooting a high-powered rifle from the doorway of his home.
Officer Jones was shot multiple times by Brown, according to Chief Goldsmith. Officer Allison was shot while trying to assist Jones.
Several neighbors, including Steve Koptchak heard the earlier shots that killed Rodriguez and then heard Brown speed into the driveway at his house. Those neighbors were outside at the time of the shooting.
"It was instantaneous," Koptchak said. "As soon as the dude stopped the vehicle, gunfire started raining down," he said. "There was probably 30 to 40 gunshots, there was an awful lot of gunshots."
Surveillance video provided exclusively to 13News Now shows the moments immediately after Jones and Allison were shot. Brown speeds off in his car and an army of police officers rush to the scene. Some officers pulled up in cars, many ran to the scene on foot.
"Police officers [were] running everywhere," recalled neighbor Roberta Howe. "I had more cruisers, more police, just running absolutely everywhere."
As officers were responding to Jones' aid, another officer was chasing Brown as he sped across East Little Creek Road and hit another car, fled from his vehicle with a gun and refused to comply with a third officer's commands.
When the officer tried to arrest Brown, police say he began to fight and attempted to disarm the officer. During a struggle, Brown was shot and killed by police. Brown was pronounced dead at the scene.
"The police officer tried to subdue the suspect but the suspect went for his weapon," Nick Ortiz said. Ortiz was inside his house with wife, roommate and young children when he heard Brown crash his car and ran outside to see what was happening.
"I started hearing the shots and I told everybody in my house to just get down on the ground," Ortiz said.
Brown crashed into Tiffany Bottoms' car, which was parked along Galveston Ave., near East Little Creek Road. Bottoms was in bed sleeping.
"I got up, jumped up, went outside and I looked and I seen the red car-- I didn't notice my car was way back there," she recounted Saturday morning. I started screaming 'My car! My car! My car!'" she said.
Officers Allison and Jones were transported to Sentara Norfolk General Hospital for gunshot wounds.
Allison, an eight-year veteran of the department, was treated and is expected to make a full recovery, police said.
Officer Jones died at the hospital. He was a five-year veteran of the department and is survived by his wife, two sons and a daughter.
"He's trained, he responded, he did everything he was supposed to do," said Chief Goldsmith. "My heart goes out to the family, my heart goes out to anybody that worked with him. I'm a cop just like everybody else is. This hurts...when one of us goes, especially in the line of duty like this. It's tough."
Police continued to process three separate scenes Saturday -- all in the vicinity of Tidewater Drive, Wellington Road and Little Creek Drive.
Norfolk Mayor Paul Fraim expressed his condolences for the families of Officer Jones and Mark Rodriguez during an early-morning press conference.
"We express our grief and gratitude for the service of Officer Jones and certainly express our condolences to his wife and children and his family," Mayor Fraim said. He added, "We are deeply concerned for the loss of this young man, Mark Rodriguez. All of this happened in a matter of moments."
Fraim went on to say that there are "a lot of unanswered questions and not enough answers."
Online court records show Brown was convicted in 2010 for assault of a police officer. He was also was convicted of carrying a loaded weapon in 2012.
Chief Goldsmith said Saturday that it is too early in the investigation to determine a motive.
"The city will come together. We will begin to digest and understand what happened," Mayor Fraim said.
Mark Rodriguez was a rising senior at Norfolk Christian Schools. School officials tell 13News Now they believe the young man had just dropped off a friend following graduation ceremonies when he was killed.
Pat McCarty, the head of Norfolk Christian, sent an email Saturday to the school community asking for prayers for the Rodriguez family, as well as the family of Officer Jones.
"I have been praying, weeping and trying to process this information for hours," McCarty wrote. "Knowing that Mark’s sweet smile is looking at the face of the Savior he loves, knowing that his worship is sweeter than he ever imagined, does not help my heart accept that we have lost him for a time."
In April, Rodriguez blogged about Heaven, saying, "God is super good. I can’t wait to be with him forever."
"He was so looking forward to heaven and that is what Mark would want people to focus on and that's where he is right now. He is with Jesus," school spokeswoman Janita Smith told 13News Now.
Norfolk Christian is holding a school-wide prayer service Sunday at 2 p.m. Counselors will be at the prayer service for anyone who needs help coping with their grief, Smith said.
I know the Rodriquez family. The father, Carlos, used to be a pastor at Trinity Church in Chesapeake, VA.
yeah I don't know the family in question but my parents worked at NCS for a little while and I went there in lower school for a couple years
Kept on seeing this face.
