EDIT: Did some more reading on the whole Bank situation, and apparently another reason Nintendo took it down was the fact that the filter that prevented hacked Pokes from being transferred over did nothing. Don't know how true that is, though.
EDIT2: Yeap, hacked Pokes in XY are a thing. Article on Kotaku shows pics of crap like shiny starters in Masterballs, level 1 Gengars and other such things. However, theres an easy way to tell the difference (in case people don't know). That little blue diamond shaped thing on the bottom of each Pokes screen that seemed pointless is there to tell the difference between hacked and legit Pokes. If it has the shape there, it's legit. No blue diamond on your screen and you've got a hacked Poke. None of the Pokes in the pics I saw had the shape, so yea.
EDIT3: So apparently the online battle filters work just fine. Things like Iron Fist Infernape can be used with no problems, but things like Thick Fat Tepig and Sheer Force Feraligatr are a no-go. No clue if the GTS/Wonder Trade filters are blocking hacked Pokes, though. So yea.. hacked Pokes can be in games, but you can't do much with them.
