    I believe they have the rights to say these things. I also believe they're getting to the point where someone will willingly accept the cost of violating those rights in a fit of grief and fury, and I would find myself hard-pressed to feel any sympathy for the results. In fact, I might have trouble not showing visible enjoyment of said results.

    It's like watching someone tease a wild animal repeatedly, then end up getting torn to shreds when he takes one step too close to the chained beast. Regardless of his ability to do so, it was fucking stupid of him to engage in the activity.

    Oh no, don't get me wrong. I wish bad things to happen to them as well.

    I'm just saying you can't even start THINKING of "Well lets make a law that prevents them from saying those things" because it's a very slippery slope once you start.

    Correct, I don't think anyone's challenging the legality of their actions or even saying they shouldn't be able to, just that it's a bit of a gamble on their part to assume that everyone's going to have a measured response to them being doucebags during an emotional time and not just flip the fuck out and gun them down.

    sadly, the courts agree. if you check the wiki page on WBC it gives a lengthy court history. 4-5 states passed laws limiting funeral protests, most of them for military funerals, and theres now a national law saying protests must remain 300 ft away for a period of 2 hrs before to 2 hrs after a military funeral. a family was awarded ~10 mil in damages, but the case was overturned in a higher court and that ruling was upheld several times, on top of the family being ordered by the court to pay $16k to cover the churches legal costs. they've been banned from the UK and canadia.

    do we need a general WBC hatred thread where these derails can be directed?

    I'm of the belief that while laws should not exist that limit the speech of people, there should be laws that prevent people from spewing obviously inciting words because they have the "freedom" to do so.

    Again, it's very hard to draw a line in the sand and say "This speech is okay, this is not". You can say things like yelling fire in a crowded theater is putting people in harm's way, but this doesn't put people in harm's way. Censoring speech you don't like just because you don't like it is a quick way to censor all speech.

    A good but simple example is yelling "fire" in a crowded space. What Kuro said makes perfect sense because we already do that. You cannot yell something in a crowded place with the intention of causing a riot/panic/stampede.

    Except not. How does anything that the WBC are doing causing immediate danger? As much as I hate them, they aren't doing anything remotely close to yelling 'fire'.

    If they go and protest at a persons funeral spouting hate speech with the intent and knowledge that it could incite violence then they are doing exactly what shouting 'fire' does in a crowded place. They are saying the things they say for the express purpose of eliciting a strong response from other individuals.

    The reason WBC is allowed to continue is because it has a religious premise. If they had none and were just out there saying soldiers died because MURICA supports dirty jew kikes and whatnot, then you'd probably see a much harsher and swift response. The religious premise makes it a tricky subject.

    While the 1st amendment protects free speech from government intervention (and not from someones fist), the fact that they also fall under pretty much the original reason for our colony existing (and probably pretty close to the type of people who burned witches too) makes it hard to say "hey you, stop being an asshole" because muh freedom.

    In the end, I don't see it as the same as yelling fire in a theatre. This action elicits a predictable and rational response - get the fuck out. Being mad at some religious (lol) persons words, regardless of your current stress or grief level, is pretty dumb. If my country can expect 20 year old me not to kill anything that moves when a buddy dies overseas, I find it completely reasonable to expect that people in the US not get upset over fucking words.
