Yeah, something about a struggling student living on close to nothing. No sympathy at all. I can't say I would be sympathetic either in that case.

I have no idea how I would respond if this actually did happen to me. When my canopy off my truck was stolen I went straight to the police and they found it for me. I didn't get the option to press charges because they found other stolen property and the state took over. I was definitely upset enough to beat them with whatever large object I could find. Talking about long term consequences is easy to do when it's not your stuff they stole.

Most likely what's going to happen is you will get your bike back from the pawn shop, then the pawn shop will be the new victim in the crime and the penalty to the criminal will only be for the amount the pawn shop gave him for your bike and maybe charged with selling stolen property.

They have him on camera walking onto a school campus with a pair of bolt cutters though and stealing the bike. He can't get in trouble for that? Pawn shop antics aside

Oh he will. Regardless of the fact he sold it to a pawn shop. He's going to get nailed for theft, sale of stolen goods, fraud. It's just a case of is this his first offense or does he have a long rap sheet. If he's done this before they will go harder on him. If it's a first time he may just get a couple of months plus some community service.

Okay, so the pawn shop does have my bike; the cop gave me a few options,

I went and took photos of the bicycle. I also signed the release form for the Pawn shop. It short terms, there are three ways to get the bike back, 1) pay the pawn shop $115 (the amount they paid out), 2) petition the court and 3) wait until the complete end of the case. If you pay the $115 keep the receipts and we will ask for repayment at the time the person is convicted.

That being said, I'm going to go ahead and pay the 115, and hope to get it back later; and if not, that bike is worth way more than 115, so that's a small hit to take in comparison.

I just want to know how big the damage is going to be. I bet my fucking $120 of bike lights were conveniently removed by either the pawn shop or Mr. Mears

He will get it back if the case is completed and the guy convicted if he pays now. It's a legal matter.

It's kind of interesting that the detective says "...at the time the person is convicted" instead of "...if the person is convicted," almost as if it's a done deal.

I'm not saying the suspect is innocent or anything, but I thought that officers (in the USA) are supposed to go with presumption of innocence, and doing otherwise can really hurt the prosecution (i.e. something the defense can pick at)?

"Presumption of innocence" is more of a judge/jury situation than a cop situation. i.e. You don't have to prove you didn't do something, they have to prove (in court) that you did.

When I went to pick up the bike, the manager of the pawn shop said he looked further into it and that guy has a bike currently at every one of their locations throughout Pinellas County. I'd say he's pretty fucked on this one.

Anyways, she's home and they didn't even strip the lights or computer (About $150+ worth of accessories, I thought for sure if he didn't strip, the pawn shop would have)

Right, but I thought if the defense can show that the detectives involved were in any way biased against the defendant ("he thought I was guilty from the start!"), it would hurt the prosecution. But then I guess the detective isn't an active witness here, so it probably doesn't matter too much.

Either way, glad you got everything back, lights and all!

EDIT: It's possible the owner actually stripped things, but then put them back on after he realized it was stolen. If he stripped them, and only returned the bike to you, I imagine he could get into a heap of trouble if the topic ever came up.
