it's the equivalent of taking the $0 dollar item through the checkout process and 'purchasing' it. Taking advantage of an error you have not caused is not the same as stealing, although it is arguably still 'wrong'. You are still completing a legitimate and above board transaction, it just happens to be one based upon erroneous pricing. Stealing involves bypassing the transaction phase entirely. I remember once circuit city had a deal where buying an xbox accessory gave you a free xbox gift card, and xbox gift cards were considered an accessory, enabling you to bogo the cards, essentially doubling your money which was almost certainly not intended. However it was following the rules of the transaction, and thus not stealing.

If you just walk out with it, that's stealing. If you take it to the checkout counter and they ring it up, that's not stealing.

I saw some screenshot of a person who reported it through customer service, the rep said "hey I checked with my manager and he said it's supposed to be like this, so go ahead." If that's stealing, then I don't know how to argue it anymore.

I don't own a xbone and I don't like Fallout 4. I have no horse in this race. I just think that the pro-corporate fake moral high ground angle is incredibly stupid.

One time I was buying groceries and I had some misc items, and a 12 pack of soda on the counter. The clerk didn't ring up the 12 pack of soda (I wasn't trying to hide it or anything, she just forgot). I noticed, didn't say anything. My reasoning was well I made the attempt to buy it and the clerk fucked up, so my conscious is clear. I told my friend about it and he went full on with the OMG I CAN'T BELIEVE YOU STOLE IT stuff. Whatever, free soda.

the rule is if you notice it within a reasonable timeframe, you're supposed to say something, give them a chance to correct it. they often don't. i've done it before. noticed they didn't ring something up after i'd paid, they just waved me away and said not to worry about it. more hassle than it's worth, sometimes.

digital products, as ever, get ahead of the law. in addition to being objectively different. you're not buying a product with games anymore, you're buying access to a service. first dose is free and all.

in regards to the free game thing, I don't really care enough to talk about it much more, but don't get the false impression that my jimmies are rustled by people trying to get shit for free. I'm simply amused that Microsoft's answer to thousands of people taking advantage of them was rewarding them with store credit.
