The photo shown is Ben Reilly, aka the Scarlet Spider. He had that guise for awhile before taking over as Spider-Man full-time when it was revealed that he was, in fact, the original Peter Parker and the Spider-Man we knew had been a clone since the original Jackal story (sometime in the 1970s).

At the conclusion of the clone saga, Reilly is killed by Norman Osborn, revealed to have survived the supposedly fatal glider strike, and degenerates. This proves that Reilly was the clone all along and the entire clone saga was a manipulation on the part of Osborn.
