    Getting a new job while on FMLA

    I hope someone can help me here, as googlefu has not been helpful.

    On April 22ndish, I'll be going ton FMLA for a new baby. Today, I interviewed for a new job at a new hospital. I don't really understand the dynamics behind this. Do I put in a 2 weeks notice while on FMLA?

    You can put in your notice while out on leave. However most companies will not allow you to use any paid time for time off during that last two weeks. In short if you do it, expect unpaid leave rather than burning vacation/sick/personal time to cover your absences.

    Sick time is all I'll really lose out on, as they'll pay out my vacation, holiday, and personal time when I leave. Thanks for the answer.

    I thought companies were required to compensate you for any unused paid time off when you left so even if they don't let you "use" it when you get your last check it should include payment for unused paid time off. Or maybe i have just been lucky that this is the policy of everywhere my wife and I have worked so far.

    That's individual company policy. There is no legal obligation to pay out unused vacation time. Some companies do it, some don't. Mine doesn't. We also will "bill" the employee on their last paycheck if they've used more vacation time than they were allowed to use(ex I worked 3 months but used 9 out of 12 vacation days. I would be charged for the last 6.)

    It just depends on the company.

    In California, companies are legally obligated to include unused vacation in your last check because paid vacation benefits are considered wages.

    It strikes me as odd that in theory a person quitting after the first quarter would be entitled to a payout for the year's worth of vacation. It's not a law here in Pennsylvania. Seems kind of weird imo.

    Most companies I have experience with give you some paid time off each pay period and you can either save it up for a maximum amount each year or you can use it as you earn it. The company I was laid off from a couple of weeks ago gave me 6 hours of paid time off each pay period. When I was laid off my final check included a payout for the 30-something hours of unused paid time off that I had saved up.
