    not sure how jailing someone for a jailable offense constitutes 'vindictive cruelty', especially as the prosecution was tempered and sought a sentence far below the maximum allowable. it is not disputed that he deserted his post and in so doing put the lives of other soldiers at risk, and the Taliban's punishment (stemming from his own idiocy mind you) does not somehow absolve him of legal culpability in an American court.

    Retired Navy SEAL Chief Petty Officer James Hatch testified that he and his dog came under fire while looking for Bergdahl. He was shot in the leg, and his K-9 partner, Remco, was shot in the face and killed.
    "I thought I was dead," said Hatch, who now walks with a heavy limp after 18 surgeries. He said he was concerned because there was little time to plan the search for Bergdahl, and other soldiers knew he had willfully walked away.

    Shits a joke. He got off light considering the amount of lives and man hours dedicated to finding this asshole. By 2013 it was already an open secret in dirkastan that he deserted.

    Hope he gets hit by a bus the second he steps outside.

    Well, if we're skirting the fact that he shouldn't have been admitted into the military to begin with, and absolving them of culpability for overlooking his history of mental illness.

    I'm not going to defend his actions. He was a mentally ill, but utterly narcissistic individual, with delusions of grandeur, all of which led to him enduring 5 years of torturous imprisonment.

    The U.S. would be an even bigger focal point for humanitarian criticism if we spent such monumental effort to free him, only to imprison him again, for as long or longer. But we have a growing history of subjecting people to inhumane standards of living to make examples of them, so I shouldn't be surprised there are those who would defend such practices.

    I'd like fewer instances of black and white judgment in our judicial system, and the failure to recognize what he's already endured -- yes, due to his own choices, but all the same -- is an instance of seeking blind retribution, rather than an attribution of consequence, because he's already suffered harsh consequences. Regardless of if it's legal, it's immoral, and unjust.

    I don't know if I would ever describe him as getting off "light," or "lucky," because societal ostracisation will ensure his future won't be pleasant, and considering the further mental illness he no doubt has, I would also not be surprised if he commits suicide without rehabilitation.

    Military justice is different than civie justice. You can talk all day about how our prison system should focus on lowering recidivism rates and incorporating felons back into society, it does and it would be nice if people in power would focus on it as well. This however is entirely different as it is a military criminal issue and should be punished in the way that military courts would deem such an act to be punished.

    Thought I read one of the reasons they let him off lightly was that they were able to get a bunch of information on how the Taliban were able to move around and hide prisoners due to his time as a captive. Doesn't justify the fact he deserted his post but yeah, dunno how much jail would have done after 5 years in captivity being tortured.

    That's more of a disagreement on individual sentencing.

    I've personally know several people getting time for hazing one guy. I believe that was 1 year think leadership got a little more. A guy for looking at cp... pretty sure he got tried in civilian court and punished there too lol. Not sure what the civilian courts did since I lost track of him after the court martial and it was still pending but military gave him a year, forfeiture of all pay during that period, reduction to E-1 and dishonorable upon getting out of military prison

    One guy facing friggin treason charges for writing an email to a gf that he was finally in port while they were on the maneuvering on the surface within sight of land because he was "reporting ships movements"... oh he also thought better of it and didn't hit send anyways. They were still awaiting court martial last I knew so no idea if he got time or not

    This guy could've been charged with life. So yeah compared to what he could've gotten and what a lot people in the military have gotten no time is light

    I know a guy who got court martialed and put away for 18 months with a dishonorable discharge because some chick showed up at his apartment, gave him a blowjob, and then fell asleep on his couch wearing lingerie and he took a picture of her. She accused him of rape and it got knocked down to "sexual battery" because he took the picture. Had been in for 16 years and the girl, a Marine, had previously leveled false accusations.
