I don't see how that could be used as a mitigating factor for the purposes of disproving intent. Whether or not he was high should have no relevance to whether or not Stewart wanted to hit him.
Weed gives -5 to dexterity.
Guy he hit was under the influence, several attorneys have stated the toxicology could be used in the case against him and to benefit stewart.

The lawsuit accuses Stewart of gross negligence, saying he gunned his engine and put his car into a skid as 20-year-old Kevin Ward Jr. walked onto the track after a crash at Canandaigua Motorsports Park on Aug. 9, 2014. The car struck Ward, and he was killed.
I just don't see how it's going to fly with the fact the guy was retarded, got out of his car and was challenging Stewart before he got whacked.
You can charge at a speeding car, mid race, get fucked up and expect sympathy. If his family thinks they'll get anything out of this they're just as retarded as he is.
