    Meanwhile, Ferguson PD was arresting dozens of media people and holding them for hours before releasing them without charges. Can't bully the bullies; that would just be unfair.

    Officer and veteran Dawon Gore, 44, of the St. Louis County police department is currently suspended without pay and facing charges of second degree assault after allegedly breaking three fingers of a 24 year old man with his baton during a confrontation.

    “Officer Darren Wilson is White, I am a Black Officer. Wilson didn’t do a report, I also chose not to do a report. Both subjects were black males, Wilson’s subject had cigars but was unarmed and my subject was found not to be armed as well. Wilson drew a weapon (gun), and I drew my metal baton.”

    “I’ve been embedded in St. Louis County for 14 years and I am going to tell you this on camera, that’s the worst entity I have ever worked for. I’ve been in the military, I’ve served the St. Louis metropolitan police department… but when I got there I ran into this big wall of cultural bias that I had never seen before.”

    You're right about the Grand Juries, and I was assuming they were prosecuting federal since the motion was filed through the U.S. District Court, which always has a Grand Jury presiding.

    Nevertheless, you and about a million other people still don't get that this type of thing takes time.

    The grand jury just gives the police cover, so that if they do come back with a true bill the police can say "our hand was forced, we HAD to arrest him." Plenty of states don't even use grand juries, so lets not pretend that they are a necessary precondition for police to do their jobs and arrest other police who are strongly suspected of murder.
    This is the biggest complaint I commonly hear from people: People complain the police cover for each other, there's no transparency in a police investigation, and they can bring up false charges/evidence to prosecute you. Grand Jury is compromised of Civilians. Why you would NOT want a Grand Jury to review a case? Isn't this what people want? Accountability and an impartial investigation in to the allegations that aren't tainted by police corruption? People to review the case that's not police biased or on police payroll? What the hell do people want???????

    You don't snap your fingers at stuff like this and come up with an indictment. Have you ever served on a Grand Jury proceeding or testified before one? It's not like the TV shows. You're laying everything out there and trying to convince a room full of people who likely have no idea what the police or an investigation looks like, and you have to explain it to them to make them feel as if a crime has been committed. That includes explaining what Governmental Immunity is, and convincing them that a police officer acted outside the scope of it.

    This guy got crucified on reddit and 4Chan for trying to play the innocent one after he got suspended for excessive force. His GoFund campaign to raise his own legal defense got shut out completely. Disgrace, and a coward for trying to play patsy when the heat got put on him.

    Detaining, not arresting. You're arrested when you're charged. Semantics, but whatever. Also, Ferguson police were not part of the riots, it was St.Louis and the MSHP. So technically, Ferguson PD has been sidelined since the shooting.

    No. All conjecture at this point. Supposedly he has a history of excessive force complaints and had been up for internal review several times.

    People think Ferguson was a bad department, but the St. Louis PD surely aren't any better. If this guys accusations were true (doubt if they were) then they'd be in some DEEP shit.

    If this guy isn't charged after how many eyewitness accounts there are supporting evidence that this was a cold-blooded murder, there will be a massive shitstorm directed at both the local prosecutor and the governor.

    "Do you see the shooting anywhere in this video? No. All you see is bystanders a couple hundred feet away raise their arms, and the voiceover could have been dubbed in after. Theres a reason this video only came out a month after the event in question"


    Now, I'm no lawyer, but im pretty sure a professional lawyer could dissect that even better.

    The latest evidence that the fix is in came this week from The Post’s Kimberly Kindy and Carol Leonnig, who discovered that McCulloch’s office has declined so far to recommend any charges to the grand jury. Instead, McCulloch’s prosecutors handling the case are taking the highly unusual course of dumping all evidence on the jurors and leaving them to make sense of it.

    McCulloch’s office claims that this is a way to give more authority to the grand jurors, but it looks more like a way to avoid charging Wilson at all — and to use the grand jury as cover for the outrage that will ensue. It is often said that a grand jury will indict a ham sandwich if a prosecutor asks it to. But the opposite is also true. A grand jury is less likely to deliver an indictment — even a much deserved one — if a prosecutor doesn’t ask for it.

    Does it even matter if his hands were up if he was moving toward the officer? Everyone knows if a cop has his gun out you get on the fucking ground, you don't move towards them... If the cop was shooting while they were running I'd question that, but if the guy was moving toward to cop - I think some testimony said he moved like 25ft toward the cop while the cop was backing up - then not sure there's anything to prosecute in terms of murder... Maybe lose his badge for excessive force while they were running away if he was shooting?

    Funny, because when knifeguy got shot, pretty much everyone agreed that "anyone who advances towards a cop with their gun drawn is asking to get shot".

    Removing race as a topic neph explain to me why there isn't a requirement for the cop to justify the shooting in the death of an unarmed civilian.

    I work IT but even I'm required to prove and back up the work I do. And it has to be immediately viewable.

    Why are cops immune to such basic "cover your ass" requirements?
