What happened in the car is not irrelevant if it lead to the cop feeling threatened for his life. The bruising and scratches on his face support this.

He walks if they can't prove Brown surrendered after this; and just fyi there is already video of a witness chatting that supports Wilson's report that Brown charged at him afterwards. Why do we ignore that witness again?

What happened in the car is quite possibly the most important piece to this case, and saying it's irrelevant is just silly. Someone who has possibly never experienced this type of threat cannot even begin to fathom what it's like to stare death in the face.

Imagine for a minute:

You're driving down the street as a police officer. You see two guys walking in the middle of the street. You shout to them to clear the road. A minute later, a large man is attacking you through an open window. Time and again, he punches you in the face and temple. You're starting to lose consciousness, every hit flashes a bright light like a photographers lightbulb going off in your head. And it hurts.

You're fighting to keep yourself awake. You're starting to drift at that moment, your mind wandering to your wife, your kids, your family, everything comes together at once. You start to think about your bills, your mortgage, your car payment, your kids first steps, or maybe the first day of school is tomorrow. Who's going to take little Girl to school? Oh, yeah. You are when you get off. You remember when she was born, all cute and snuggled like a little burrito, which is how she got the nickname "Burrito".

You laugh to yourself, remembering the good times and how you felt when you held her for the first time. The first time you kissed your wife. The first time you made love. The day of the wedding when your best friend got absolutely trashed and nearly knocked over the wedding cake. Everyone laughed. Good times.

But, what is that? Time speeds back up, and your mind clears for a second. You caught second wind for a moment because the lights stopped flashing. Out of the corner of your semi-concious state, you feel something. Your body is being pulled at the hips. You sense danger, and you don't know why. Opening one eye, you try to clear the blood with a busted hand and realize someone is on top of you, scratching and clawing at your face and is grabbing at something on your side.

Oh. My. God. He's reaching for your gun! He's trying to kill you! Time slows again. All that stuff you just remembered comes back and hits you again like a ton of bricks. You think about what life will be like without you. How will the wife survive without your paycheck? You've only been on the force a few years, and death compensation benefits were terminated by the state a few years back. There's insurance, but it's not a lot of money.

What about the little boy? He can't even walk yet... I'm going to miss him walking, you think. I can't teach him how to walk now. I wonder if he'll be a doctor. Hopefully he won't be a police officer. This job sucks. The little girl will be okay. She's a toughie. She can handle being big sister while I'm gone. And, the Wife. She's so beautiful. I love her so much. I will miss her smile the most...

No, you think to yourself. Fuck this. I don't want to die! I'm not ready! There's no way I'm going to miss little John's first steps or the little Girl's first day of school. I want to go home! I want to hug my children! I will live!

You remember your training. The countless hours of preparation and drills prepared you for this. You execute a right block across his chest to force him back. He doesn't move, but he let go of the gun. You do it again, and he comes back in with another hit to your face but this time, you were ready. You block and hit him back with your forehead. He screams and starts hitting you again.

Butt, you smile, because him working on your face gave you just enough time to unhook the retention strap on the gun and draw it out. Just like you practiced in CQC shooting, you execute a side chop to the upper pectoral region with your support hand, turn your body just enough to clear the seatbelt tangling your body, and pull the trigger...

I'm going home today.

No one will read this, but this is the perception. "Oh so, Michael Brown thought this same thing too, huh?" I dunno. Probably. I can't paint a picture for him, because I didn't die in my first OIS and lived to tell my tale. You know what I do know? Shit about what happened in that car that led to Browns death.

All I know is I, like many of the 800,000 LEO's across the country have experienced something similar to what happened to Darren Wilson, and sympathize with his actions and responses.

Sorry, long rant.

Yeah because a white cop telling two black guys to use the side walk and not the road to walk is instigating a confrontation.

I get what you're saying, but he's right. We still don't know if he instigated it or not. Likely scenario, to be honest.

When a cops testimony matches testimony heard off camera moments after the event you have to wear a pretty big tinfoil hat to spin it.

I have no problem admitting that Brown probably had his hands up, the problem is that I don't think it's considered "surrendering" if you're moving towards a cop with a gun drawn on you - especially right after being in an altercation with the same cop...

The reason I hadn't commented on the video, the second time it was posted, was because it wasn't posted in the context of why "eyewitness testimony is unreliable". To me, none of those videos (whether for or against) really paint a clear picture of what happened.

I'm pretty sure he was directing that at Bum, but either way, this is the point of that video. Bum keeps questioning why we can't just take the eye witnesses at their word, this video is the reason. Different witnesses have said completely different things.
