Read an article today that touched on something I hadn't seen mentioned elsewhere. Davis may be immune from "firing" until January, but a federal judge could put her position in receivership. From wiki on the term-

Receiverships are also a remedy of last resort in litigation involving the conduct of executive agencies that fail to comply with constitutional or statutory obligations to populations that rely on those agencies for their basic human rights.

Essentially the judge can appoint someone to take over the position and make sure shit gets done correctly.

Part of the problem is that while a person can honestly answer that they've only had sex with their male partner for a year - they can never say the same for certain for that partner. I believe (but am not sure) that this brings the question in line with what they ask women - "Have you had sex in the past year with a man who has sex with men?"

If the MSM population in the US didn't have such astonishingly high rates of HIV+ compared to the general population it wouldn't be an issue, obviously - it's just a rough demographic.

Right under the whole guy on guy thing is it also includes being a literal whore or having sex with anyone included in those at risk behavoirs in the last year

I donate regularly and have tons of gay sex with my husband, I just lie. You or your loved ones may have already received my filthy gay blood without even realizing it! (I don't have HIV btw)

Either way even if someone's HIV positive blood did slip through the cracks, they test it anyway so who cares. I imagine a ton of straight people have unknowingly donated their infected blood and it was thrown out once it was tested.

The tests aren't 100% accurate within a few weeks of infection, that's the problem. If the tests were 100% accurate this wouldn't be an issue.

There are near zero tests that are 100% accurate regardless of when the infection began. Basically all tests have some false negative and some false positive rate, however minuscule.

Of course - I shouldn't have said "100%" - what I meant was the tests are very unreliable for a newly infected person for at least a few weeks after infection.
