    If you can't drink and consent to sex, then anyone who drinks and drives should be off the hook for DUI. Can't have it both ways. Officer, I was inebriated and therefore not able to consent to driving!

    You're not thinking with insane enough logic. If I drink and drive, I get a ticket. Ergo, drinking and then sleeping with someone should get you a ticket too!

    I think we can take this a step farther... I mean really it's the car manufacturers fault for not putting breathalyzer ignitions on cars... by letting you drive while you aren't able to consent to it they are basically forcing you... That's basically attempted murder right?

    In the military, getting a DUI is pretty much a death sentence for your career. Too many (like, 2, basically) means you're probably getting a dishonorable discharge.

    The reasoning behind this, even though you have 21 year old kids coming back from deployments and all sorts of shit that causes them to make bad decisions, is that before you go out and drink you have the option to a) Plan ahead and use a designated driver or take a cab and b) always be with friends/other soldiers --> which follows to c) supervisors and NCO's/Officers to make sure they know what their soldiers are doing, educated, have a plan, etc.

    If you get a DUI, you failed to be responsible enough to do something as simple as planning ahead for the evening.

    If all sex under the influence (obviously SUI's) was treated the same way, it would be victim blaming.

    Not in the navy. A dui is practically an unwritten requirement for making chief lol. Except maybe in Guam... cause if the cops there actually write you up you know you dun fucked up good. Seriously know of one cop there that told a drunk driver to drive home real fast so he could get home before someone caught him drunk driving <.<.

    I knew a guy who was a felony sex offender because a girl was drunk when they had sex. without getting into the details of his case, the part that is relevant to this discussion is when he told the police officer that he was drunk as well and asked if he had filed charges first, whether she would have been the one who was the rapist. the officer's response was basically "according to the law... yep."


    this is normal drunk btw, not passed-out or incoherent drunk. that's a different story entirely and that is rape.

    That might've been how it worked in 80s and 90s. But nowadays that shit doesn't fly.

    Nowadays if you ass is arrested for even a suspicion of DUI your ass is headed straight to DRB, XOI, and Captain's Mast before the next week is even over and you're looking at Reduction in rate, 45 days of restriction, and whatever reduction in pay they can do to you (usually half month's pay for two months).

    You can salvage your career (E-6 promotion periods look at the last 3 years worth of evals, E-7 Looks at last 5 years) but generally its career ending. A second DUI will likely get you kicked out of the navy.

    Its the same way with PRT failures now. If you fail a PRT as an E-6, good luck on making Chief in the next 5 years. (Source: Active fucking duty)

    Maybe now I'm out so no comment but even in the 2000s it was like that though was somewhat dependent on who you were. Had a 6 year EMC come to our boat fresh from a couple of DUIs to the point where he had a breathalyzer ignition back in 2006. Though I hear he eventually got kicked for cocaine

    Also somewhat depends on rates. Like I was a nuke ET submariner... well advancement rate back in 08 when I was supposed to take the E-6 examine was 96%. For a good year or so we had no chief and when we asked why we weren't getting any the answer always was well we promoted everyone that wasn't on FEP and still had 4 more billets than chiefs and screw boats in the docks. They actually made that EMC I talked about or sorta chief for awhile since with no one in the goat locker we just weren't being informed of anything that wasn't in officer/lpo call

    In my unit you were hit with the largest punishment they could muster through an Article 15, you served that time getting shit on by people who know how to shit on other humans, then you were RFS'd (released for standards) and sent back to the regular Army. You didn't get to pick where, so this was often Korea (which contrary to you fucking otaku faggots is not a good posting) or somewhere else that was fucking terrible.

    Edit: And I'm fine with that + think civilian punishment for DUI should be life ending.

    I don't find it unreasonable to have a plan and know what I'm getting into, just like I don't think EVEN IF I AM BLACKOUT DRUNK that I can be raped outside of being forced, physically and violently, into a compromising position. When I am blackout drunk, my friends have never had any idea that I was basically not in control of myself other than the fact that I am a crazy motherfucker when this occurs. If they can't tell, how is some chick I'm talking to supposed to know? Vice-versa, how would I know if a chick was?

    Sex is a consequence of your previous decision to leave the house, drink, party, and engage with other humans socially. If you aren't ready for that consequence, you shouldn't drink. Removing that factor should allow you to maintain your super strong resolve of being a boring individual.

    In control relative to your current level of intoxication. Basically being blackout drunk isn't being possessed and unable to influence your actions at all, it's just not remembering what you did very, very recently. People just tend to freak out about things like that, even though it's pretty standard.

    Can confirm. A couple years back our DM got blackout drunk during a session and was as lucid as any of us for the duration of the session. Sure he made some poor decisions like allowing us to engage in elf-tossing, but he was as aware and engaged as he usually was. It's just that the next week he confessed that he had absolutely no memory of what happened during that session.
