    You call people dumb, and yet, after how many pages of discussion, you still seem to think the NFL is subject to the typical legal system and its rules.. What part of Goodell hearing the appeal is hard to wrap your mind around?

    Hell, the Pats can fight for an independent arbitrator like Tyche said, but the NFL is under no obligation to concede and let anyone but Goodell hear the appeal.

    You're wrong. The NFLPA is a union. Goodell has lost in court before after handing out ridiculous punishments. If he doesn't over turn the suspension himself, Brady can take him to court as a union worker. Kraft can also take the NFL to court and essentially argue that the punishment is ridiculous and an attempt to rig the game and eliminate fair play by unfair treatment. I'm not claiming to be a lawyer or an expert on these matters, but I know it doesn't begin and end in Roger's office.

    I don't think you understand what a union is..

    Goodell and the league have lost in court when his punishments disagreed with previously agreed upon punishments. The best case being Rice this previous year -- the previously established punishment was 2 games. Goodell and the league came back and hit him with the indefinite(?) suspension. The NFLPA could argue that point because his punishment had been previously agreed upon. How they adjusted that to the new six game suspension is another matter that would take a little research, which I don't have time for..

    However, for whatever reason, the NFLPA gave up the right to demand an independent arbitrator in cases like this and ceded the power to Goodell. Is there something wrong with that? Yes, of course. But the fact remains that the NFLPA agreed to it.

    Also, on an unrelated note, I've been drinking, so does it look like I've been misspelling Goodell's name to anyone else?

    I think the best precedent for a team or players taking the nfl to court for suspensions is the starcaps case. The nfl suspended some Minnesota players for taking a diuretic that was banned. But it wasn't a listed ingredient on the box. It was ultimately heard by the Minnesota Supreme Court. There's precedent for players and teams for that matter to seek justice in US courts. It has zero chance of happening in this case. Neither the NFL or the Patriots want to put anyone under oath, especially minimum wage employees in a high profile case.

    Look, I don't know what the NFLPA gave up to give Goodell arbitration rights during disputes like this, but unless there's some secret fund that was established to protect all past and future players from the damages they sustained from playing football, I have a hard time believing it was worth it.

    That said, did Vilma's case fall under the current CBA? Although Bountygate occurred after it was in place, the incidents occurred prior, so I would think it fell under the previous CBA -- although, I'm not a lawyer, so I might be wrong about this. The current CBA was passed in 2011 or 2012, so this definitely falls under it, and in it, the NFLPA gave Goodell the power to be the arbiter of disputes like this.

    From the article you linked:
    In Vilma’s view, an appeal under the league’s Collective Bargaining Agreement won’t work, because the CBA gives Goodell the power to either handle the appeal himself or appoint someone of his choosing to hear the appeal. Instead, Vilma thinks Brady will need a federal judge to take his side against Goodell.
    If Brady doesn't believe Goodell will give him a fair hearing, he has every right to try to take it beyond the NFL. However, if I were a judge, I would have a hard time siding with Brady because of the CBA in which the NFLPA, the union which represents the players, gave Goodell that power.

    Hell, there's a certain sentiment (which I actually share) that overturning the Bountygate suspensions made it less likely that Goodell will willingly give up his role.

    I support NL here. Brady should do exactly what Vilma did, because here is the result of Vilma's appeal:

    "I affirm Commissioner Goodell's factual findings as to the four players. I conclude that Hargrove, Smith and Vilma -- but not Fujita -- engaged in 'conduct detrimental to the integrity of, and public confidence in, the game of professional football,' " the ruling said.

    "However, for the reasons set forth in this decision, I now vacate all discipline to be imposed upon these players. Although I vacate all suspensions, I fully considered but ultimately rejected reducing the suspensions to fines of varying degrees for Hargrove, Smith and Vilma. My affirmation of Commissioner Goodell's findings could certainly justify the issuance of fines. However ... this entire case has been contaminated by the coaches and others in the Saints organization," it said.


    From there Payton was suspended for the entire year. I'd trade 4 Bradyless games for a season without Belichick. Do it Brady.
